Another question though. How long after the K-1 is submitted will it be before she can come to the US and work. i spoke to a guy on RapidVisa (which is how I found this site) who told me that within 2 months she could live in the US bit it was probationary.

Once she enters on a k1 you had up to 90 days to marry. After you marry you apply for adjustment of status $1070 fees. You must make 125% of the poverty guidelines for your household size to adjust successfully. It'll be approximately 90 days after application for her to receive EAD to be able to work. There are some guides on this site that are helpful.

Well unfortunately you cannot. You can report a consular birth abroad so that the baby will be an American citizen. Both of you go to the consulate and file the forms: http://canada.usembassy.gov/mobile//consular_services/birth-abroad.html

I'm confused, we are unable to have the child in Canada? or we cant bring him over the border?

She's better off having the baby in Canada; free healthcare, doctors she already knows, and she will be eligible for Mat. leave. You should also check out the EI Canada thread, I'm not sure if she will be able to receive her benefits when she moves to USA, but people are really helpful, it's worth checking out. http://www.visajourney.com/forums/topic/8-the-canuck-ei-thread/

I've read this whole thread & haven't even seen something mentioned. If you file I-129F petition from the state of PA, you will be routed to Texas Service Center, which is currently processing these petitions in around 5-6 month's time. And that's just the timeframe for a mere piece of the entire process. Sorry to be the bearer of bad news. I just want you to have a full picture of what you're up against.

Edit: If you read my signature, it's a decent way to gauge your timeframe.

Another edit: If my Fiancee had left to come here right after receiving her K-1 Visa, our process would've been 8 months. That said, even after she gets here, we have to apply for AOS/EAD (Work)/AP. That could be 2-4 months processing time. So from the moment you apply for a I-129F petition, it could be about 1 year before she can be here working.

This is astounding news. How exactly do I go through with this whole process? And in terms of work, I'm not worried about her working for our first year here. She will be better off at home with our newborn during that time. I was mostly asking because I was afraid it may take longer than a year. I'm happy to hear things are working out for you guys as well, congratulations on your approval.

Those cost a degree of money if I'm not correct. I'll have to look into it. Would you say it would be a bad idea to stay with her in canada and work in NY? or is this a bad idea?

Do you realize a K-1 is going to cost you 1650.00 dollars and that's not counting all the passport photos, document, etc...? You better get back to work!

You should compare the types of visa there are pros and cons for each type discuss with your girlfriend k-1 faster but a cr/ir-1 cost less
