Hello,

I have been under alot of pressure, fear, and anxiety lately over the process of immigration. My girlfriend and I met about 2 years ago online and sparked a relationship. I am from Pennsylvania, and she is from Niagara falls canada. The two of us grew very close rather quickly and I found myself making regular trips to Canada. She has had a divorce, and had 2 children with her prior husband. She no longer has the kids in her custody due to loss of her last job. She now works as a nurse.

On my last visit I received news not long after, she is pregnant. I grabbed everything I owned, paid my last month of rent, sold or stored what I couldn't take, quit my job, and traveled to stay with her. Now I'm here with her, and we are both very worried about the future.

Neither of us wants to be away from the other, but we made the choice to try to have this child in Canada due to the expense of childbirth in the US. But we want to move to PA.

I'm lucky enough to have a family who is willing to help support us in every way they can until we get on our feet. But we have no idea where to start.

I read up on K-1 visa's and think it may be our best bet. but I am unsure of what all I will need.

a K-1 visa will probably be the best for you. I am doing a CR/-IR visa for my wife and just had my petition approved.

Also if Canada allows DCf filing you could do that. It is a another fast way for you to be together. you could research that too. IT allows you file the CR/IR-1 visa while you are living there. you will have to get marry there and be a residence for a while..Also you will have to show proof of Domicile in USA and Income, but a joint sponsor is allowed. If your family is willing to help you that might be another option for you. you will also have to get visa for her 2 kids if they are coming with you. the baby when born will have automatic citizenship with you being the father. there is some paperwork you will have to file for that. I am not sure exately how that works

I'm a little confused. Job loss is not usually a reason for change of custody. Was it done legally? What about paying child support for her current kids? K1 is sounding like your only option. That or move temporarily to Niagara Falls NY, apply for a nexus card and go back and forth to visit eachother during a cr1 process.

Actually if he did CR1 visa he could live with wife in Canada and do DCF which will be faster then living in ny and visting

I don't think that Canada does DCF, but I could be wrong

is there any sort of information I should know in terms of bringing our child to the Us with us?

Her financial situation was a bit unstable at the time of her divorce. She lost her house due to so issues with family members and then was pulled over and had a expired licence which landed her in some debt on top of the loss of her job soon after. She didn't want to give up her kids, but she made the decision that it was better for them to stay with their father due to him being in a better situation with money. We plan on letting them stay with their father until we can manage to get ourselves a house. For now we are not exactly in a situation where we can support 2 children and a baby. Once I have a job again that will change. I have welding experience, which pays well where I'm from. She pays child support to her ex husband, yes. Neither of us harbor any bad feelings towards him. He's a good guy, their relationship just didn't work out.

in terms of which visa and whatnot to go for. we're ok for just about anything. but we want to try to be together as much as possible. It's more important that we are together than having money to us. But a job is really important to have. Travel to and from canada regularly seems like a bad idea due to border guards who are usually not to fond of new couples from different countries.

We want to try and get this over with as soon as possible too. I wanted to start paperwork a month ago, but we ran into some issues with a ticket I had to pay back home. The sooner were both citizens in a together country the better. We just want to start our lives as a married couple.


And I did read about co-sponsors. My family has already told me they would do anything they could to help me with that. Since I don't currently have a job, I wouldn't be able to submit anything about my current income until I returned home.... which I don't want to do without bringing my fiancee and new child with me.

Since Canada does not allowed DCF.The best and fastest will be to apply for K-1 fiancé visa. IT might be approved before the baby is born if not can do the CRBA for the baby

nexus cards are made just for that, frequent travel. That's why I suggested it. You get much less scrutiny.

Those cost a degree of money if I'm not correct. I'll have to look into it. Would you say it would be a bad idea to stay with her in canada and work in NY? or is this a bad idea?

They cost $50 for 5 years. Cheaper than a passport. If you're filing a k1 you need established domicile in USA so no, not a good idea.
