pls help ITR (1040) filling status

Timeline

My fiance ITR 2013; filling status is married filling separately. but divorce was finaliZed feb.16, 2014


would it be cause any problem?


09.06.14- Sent I-129f

09.11.14- NOA1 email

09.15.14- Alien Reg. changed

11.18.14- NOA2

02.02.15- Interview at US Embassy 

02.24.15 - POE San Francisco CA.

Embassy won't care as long as the divorce was final before the petition was filed. After that the embassy only cares about gross income meeting the 125% I-864P requirement.

DO NOT bring a copy of the tax return to CFO, instead make sure to bring a copy of his divorce decree.

Perfectly legal ITR; in fact the return would have been illegal had he filed as unmarried. Dec 31, 2013 is the key date. He was still married by then, so he filed correctly.
