Hey so I'm sorry if this has been discussed before but I'm kind of short on time I recently received my aos interview date and we've hired a lawyer to accompany us. Problem is, he wants to reschedule. The date is already later than we expected and we have a somewhat time sensitive case. Has anyone had to reschedule their aos interview and if so, how long from the original date was it?

AOS Timeline

08/21/2014: Forms filed

08/27/2014: Received NOA in mail

09/16/2014: Biometrics 

11/12/2014: AP/EAD approved

11/21/2014: AP/EAD card received in mail

01/12/2015: Interview

01/12/2015: GC approved

01/20/2015: GC received in mail

01/09/2017: I-751 package sent to CSC

01/10/2017: NOA date

02/01/2017: Biometrics 

12/14/2017: I-551 stamp good for 1 year

02/26/2018: "Case was received at my local office"

Did he state a reason why he wants to reschedule?

Yes, he was already scheduled for another aos interview in a different town on the same day. Now, I'm trying to decide whether we should go to the interview by ourselves or allow for a reschedule.

It is clearly this lousy lawyer just wants good things for himself. Rescheduling an interview will slow everything down, and you need a persuasive reason to do that. You will have to wait for another 2 - 3 months for another interview depending on how busy your local office is.

IMHO, rescheduling an interview (not because of an unavoidable reason of course) will have negative effect on your case. I would well prepare everything and go for interview without that lawyer. Everything is pretty straightforward for legit couple I believe. Good luck.

What type of visa are you adjusting from?

You can reschedule your AOS interview appointment, it is hard to determine how much of a delay ensues. You will be at the mercy of the USCIS rescheduling appointment minions, and appointment availability at your local USCIS office.

Good luck on your immigration journey.

Hi there. Thank you for your opinion. I think you brought up a good point. I don't think his reason is very persuasive enough to be rescheduling and from reading the forums, the interview doesn't sound so bad that a lawyer needs to be present.

Thank you for sharing! I did read your thread and it sounds like you guys really had a good reason to reschedule and in only 3 weeks time. What I fear is that aos won't think our reason is good enough and reschedule us at the back of the line.

From reading everyone's comments as well as reading other peoples' experiences, rescheduling is really a last resort and shouldn't be taken if there are other options to make it work. I've decided to stick with our original date and go sans lawyer. Wish me luck everyone! Thank you all for your input!

hi guys!i just want to share my sad experienced,,i feel down right now..we did rescheduled our interview..got email from uscis yesterday informing us that my green card denied..but i do have ead already...our interview date was dec.1..but dec.22 we sent the interview schedule back to them with explination that we can't attend the interview because my husband has doctors appointment..and we asked them to reschedule our interview in seattle coz we're from alaska..we're close to seattle uscis than anchorage..and then,dec 25th,we came to their office for my biometric..and we got a chance to talked with 1 of immigration officer there..we explained to the immigration officer that we can't attend the interview..she asked us to write a letter of explination so they'll be inform..

sad to say..they denied my green card..any advice pls?thank u so much..god bless

1. Every local office has its jurisdiction of processing area, you can't just come to another location because it is more convenient for you.

2. No show for interview deems abandonment, and it is non appealable. You have to start from scratches. Your EAD is invalid now.

Are you K-1? If yes, just reapply I-485 again. Sorry but will have to pay fee again. Good luck.

Yep..K-1..is that the only way?reapply?even we informed them that we can't attend the interview and we gave them a valid reason?

You confused everyone, you sent request for rescheduling interview on Nov 25? Because today is Dec 11 only. If you sent it on Nov 25, it looks like your request failed to get there or got there too late, so they denied your I-485.

Your request was made on Nov 22nd against a Dec 1 interview and you also did a walk-in on Nov 25th explaining your need to reschedule correct? It was too close to the appointment and so they took it that you didn't show up.

Did you mail your request to your local office?

Let us assume it got to the office on time, you had the doctor's appointment and then you requested a transfer to another USCIS. That would only work if you relocated to an address that the Seattle office has jurisdiction over. Seattle is another state, certainly it doesn't have jurisdiction over Anchorage, Alaska.

Wait to see the details of your denial letter and that would guide you further to either attempt an appeal or if you would have to reapply. Your EAD is no longer valid. Sorry.
