Well I hope we've all learned the valuable lesson that you don't get anywhere calling VSC (if I weren't so nice I'd say I told you so LOL). PLEASE friends, as I had suggested a while ago, once you hit the 180 days mark go to your Senator. Don't call VSC, it's a waste of your time. Niagara, don't worry about what they told you-just contact the Senator and let them deal with it. To the rest of us-our day is coming in NO TIME! Get those privacy release forms filled out LOL!

What do you think if it 180 working[/b] days?

I jst want to ask about the 180 days that if not received the NOA2 we will call Cogressman? What is all about this? My Hubby s from MD also and until now we still not received NOA2 we almost in 8 mos. after receiving NOA1 so frustrating that until now Nothing Happens.. Since we are planning to call the congressman too.. But jst want to know wat is our basis for the 180 days?

Welcome to the waiting room lol...Heina's post is precise in what they have to work at VT...consistent if you have a look at uscis timelines..they are busy with other petitions than ours....Also chek in K-1 forum, Huskerkiev's thread who is a former Adjudicator, a miracle on VJ...and see page 5, the topic about Congressmans function...and much much more...hope it helps, sorry i'm computer illeterate to bring that thread as a link for you here...

Hello everybody,

Im a new comer on this site ..i had made an id long time back ..but decided to post for the first time ..My I-130 petition is pending since end week of June 2006...its been almos 10 months !!

We too like most people tried all the possible routes ..calling up congress ppl and senators but all in vain:((.Now we might be gnmg for the K-3 route .We have called USCIS numerious times but its of no use .I dont really get it how come some pplk who filed i Aug and September are approved already ?Im happy for those who got their approvals ..but i really dont know what to do feeling so helpless ...its so stressful.Please let me know if any one of u guys is in a similar situation..Im in India nd my consulate is Mumbai..

Wow!! so sorry to hear that...you have a group from India, Middle East who share also their long waiting times on here in this site.so they feel less alone...I don't know your gender lol but usually, of what i have read there, they are more difficult with males beneficiaries from there, than with woman...what your senators, congressmans told you as the reason for the long wait??

hubby got a letter from VSC yesterday. a denial of the petition because we didnt reply the RFE! ridiculous as the petition they mean is the K1 visa we cancelled already in august and again in october when the send the RFE reminder... maybe that is the reason why they have a backlog! they working on wrong cases.

Sorry to hear that Niagara! i'm a bit confused: which petition they denied? k-1 or cr-1??..and for which petition was the rfe?.

oh it was the K1 petition that we cancelled twice... i don't really know how to put in words what i think when i think of VSC... anyway, hubby is coming here soon!!! he is going back to school, taking online classes. but that way we can live together, i can go on working at my new job. i dont know yet what to do about the CR1... maybe take everything really slow now with answering their letters. or maybe "freeze" the petition where it is now and re-open it some other day. or maybe even cancel it and then do DCF one day whenever we want to go back to the US. right now it is planned to stay in germany for 2 yrs.

even though i dont really care about my case anymore... i really wish you all get approved soon.

i know what you mean. but seriously, there are other countries than america to live in. and germany just offers more opportunities right now. so far we are not abandoning the case because if VSC goes on working in that speed, it looks like my visa will be ready in two years :devil::innocent: . i think if you would be in my situation you would do the same. staying in germany wont be forever but for right now it is just better. and who knows maybe it actually will take really a long time to process my visa? than at least i spent my time with hubby and not on a different continent.

WhaT we would do?..hm!..difficult to say, as i don't have all the info needed of your situation to say so..overall i said it in my last post: generally i have the tendency to make sure the steps i make are consistent with what I am/we are with hubby..whatever the external world would decide...on which we do not have much power, especially when they seem to make so many changes there...but still, i would go to the bottom of the problem...: investigate from where the mistake comes, us or them..then make a folow up from there to try to repair it..

For ex: we expect an rfe which did not come yet...or, in your case, did you sent copies of letters of abandonment of the k-1 with the I-130 or when they denied your noa2/i-130?..that they see you've been in good faith..of course this is what comes first to mind..but before, i would gather all the info possible and impossible of what to do in this situation..what the rules are..

I learned in this long waiting to learn how to be more patient also, 1st thing, try to be the less negative possible, even if sometimes i's really really tough..I would also think to the consequences, in abandonment of papers for much later, in the long run...on the hubby, who is USC..1st thing..I would not take anything for granted and follow the rules...even if it's hard..

I think this process it's 1st a personal challenge of experimentation with impossible and complex situations...i'm not at all the same person since we started...of course, i like deep stuff all the time...i go into deep analyzisis, sometimes too much..but in the long run it's worth because i come out at the end and, whatever the outside world's conclusion will be, a more knowledgeable person, again, 1st about myself and about us..But, of course this is only me...each person is different...I believe everybody deserves to be treated with respect, wich is not the case...our world is sick, in many aspects...we are part of it and responsible of what we are making of it....why not try to embetter it...in the smallest steps we can make...

In this perspective, i have to say it again,..i remain preoccupied with you abandoning all the time your petitions...or plans..living here, or there or elsewhere, i would be very careful with this...As of Germany...i have heard strange stories coming from there too, so everywhere is difficult...

We are not of the same age either....so our lifes are more stabilized, in a way or another, i.e. professionally speaking for example...maybe i'm wrong also of all i say here...but, but lol...in the last 1 word (oh my god this post is so long)....i would take a little bit time to think more..if all conclusions come to the same then i'll know it's the right decision..but not before i would waste all the cards i have in hand...Good luck Niagara...i'm sure you'll succeede..don't give up hope....!!! :yes:

Glad I saw this thread. Gessshhh were not alone our last touched was Aug 10, 2006 until now NOTHING :help: We're worried we just sent out our AOS without I-130 Approval but they cashed the checks already. What do you think will gonna happens? :unsure:

Hi Dezzy&Dan. Please keep us all informed of your AOS application. This topic of submitting the AOS without an I-130 approval has generated some interest on Brtishexpats forum. The general feeling is that you can't do it, and you run the risk of USCIS cashing your check, deciding you don't qualify, sending the I-485 back and you lose the money. I called USCIS my self and asked and they told me I could not file for AOS without an approved 130. Another poster said that at his AOS interview the ajudicator told him he could have ajudicated the 130 at the same time he did the AOS interview. Conflicting stories, confusing info, welcome to USCIS. I've been holding back on applying for AOS until the 130 is approved, but if you don't have any trouble than maybe I'll submit mine as well (I'm not excited about the possibility of losing the money).

This is odd. HOw do they now have jurisdiction over your case? It seems rather random.

It's not random; it's happened to several of us this week. (There are several threads, including the one I started yesterday, about I-130 petitions being transferred to the CSC.) The VSC seems to be majorly back-logged so hopefully this will help move things along for those of us who have had our petitions stuck there for several months.

No, I meant it's random for CSC to suddenly have jurisdiction over that case. It sounds in that email that they got like the USCIS moved the file to CSC because CSC was supposed to have jurisdiction over it, instead of the other way around. I used to think Vermont was pretty fast in approving petition. Don`t understand why it`s taking soooooooo long. I need my NOA2 already. :crying::crying::crying: Well i hope this means they are working on the backlog,by sending petition to other service center.Wishing everyboby that have waited soooo long the best.
