Our I130 petition has been with the CSC since Sept 2006 and our I129F has been there since Oct 2006.

Just pending-no touching, no nothing!

My husband phoned his senator as we are nearing the 180 day mark, but was told to call once we hit it!

Hopefully everybody who has been waiting so long will be approved soon. Or I'll be old and gray by the time I get to my husband!

Well I hope we've all learned the valuable lesson that you don't get anywhere calling VSC (if I weren't so nice I'd say I told you so LOL). PLEASE friends, as I had suggested a while ago, once you hit the 180 days mark go to your Senator. Don't call VSC, it's a waste of your time. Niagara, don't worry about what they told you-just contact the Senator and let them deal with it. To the rest of us-our day is coming in NO TIME! Get those privacy release forms filled out LOL!

What do you think if it 180 working days?

Hi Dezzy&Dan. Please keep us all informed of your AOS application. This topic of submitting the AOS without an I-130 approval has generated some interest on Brtishexpats forum. The general feeling is that you can't do it, and you run the risk of USCIS cashing your check, deciding you don't qualify, sending the I-485 back and you lose the money. I called USCIS my self and asked and they told me I could not file for AOS without an approved 130. Another poster said that at his AOS interview the ajudicator told him he could have ajudicated the 130 at the same time he did the AOS interview. Conflicting stories, confusing info, welcome to USCIS. I've been holding back on applying for AOS until the 130 is approved, but if you don't have any trouble than maybe I'll submit mine as well (I'm not excited about the possibility of losing the money).

Tom

Hey Tom,

As you can see my time line below I just had my biometrics done. When my husband called USCIS 2 weeks ago asking about our I-130, the girl whom he's talking to told him our case I-130 was still in pending so our AOS might be pending also. So we are just waiting to find out.

they r even slower than the developing nations

should i mention again that in germany you only have to go to the "ausländerbehörde" where they process the visa things, wait some time (depending on how many people are there that day) and then they put a visa sticker in the passport which allowes to live and work in germany for three years...

germany is getting more and more PROs on my list... too sad hubby is always so negative when im asking him to move here.

Yea, I've gotten two visas in Germany (one as a high school foreign exchange student and once as a college exchange student) and both times the process was very simple. The second time was a little more painful because I was doing it in Berlin and the stupid bureaucrats lost my file and then the one I was dealing with seemed to think none of my paperwork was good enough (telling me I had to have my parents' passport there so they could verify their signature on their letter of financial support was valid! And hten that the letter had to be in German because he didn't speak English...but my parents don't speak German!) But I got it anyway :)

If it takes a while to get this visa, I'll take a leave of absence from work and go live in Finland for a while. As i'm married to a Finn, I can get automatic permanent residency. All I have to do is go to the police where my husband lives and fill out a form and they'll set me up :) Only problem: I don't speak finnish and my degree isn't high enough to get me a job there :(

Yea but they were a completely different style of visa than the spouse ones...but still, it would seem MOST countries are better than the US as far as visas go. It's because everyone hates us. Remember?

so, my dear friends, I'm back and I don't have any good news!

Hubby called his congressman and he called him back after getting in touch with VSC. The congressman said that VSC has a huge backup (was that the word... it was back-something) and they had to take all people from VSC off their cases and fix the problems, reorganize and retool everything. That is why they have so much work now. But, and this is the funny part, the hope to approve our petition before it hits the year mark!!! Are they kidding? But their goal is to approve petitions within 90 days.... HAHAHA. The congressman said that there is NOTHING we can do but wait. He doesn't recommand me visiting the states but Hubby can come here to see me (because every man has 365 days paid vacation or what???).

Long story short: I'm expecting my visa by February 2008 as NVC wants to work on it too and then send it to the embassy over here.

Does anybody of you has any better news? I'm so frustrated... and I'm glad that I got a new job because I was tired of sitting at home and waiting for my visa.

That"s very important news, thanks Niagara. I'll inform my hubby because he let a msg to the Congressman; so we'll see. On the other hand, this huge wait your hubby was informed, seems to me quite unusual, at least, since i'm on VJ...Before I recall that California had similar problems...and as I said, Vermont send them a huge amount of K-s visas to proceede after their problem was in a way fixed. Now at Vermont, it seems all is just stucked, or blocked, they can not even move the petitions to another Service center less loaded of work...That's so strange....The only thing i can think of to find a sort of explanation is that, with illegals and with official immigration petitionners, they still can not fix the problems...they only make changes, but the workload is still not simplified...and we still have to "pay" for their problems...what a mess...hm!...

This is only a complete guess and maybe its been mentioned before in this long thread but possibly the long wait at Vermont is because of the DCF'ers in Canada. From what I understand all of the canadian files are being sent to Vermont so that they can perform a background check on the petitioner.

Dunno but it just seems that this whole waiting thing happened right around the time that the whole mess with the Adam Walsh act occurred.

And with regards to the German visas yeah Ive gotten one myself and its SUPER fast. The only wait time I had was when I first applied for an employment visa . . . they make you wait 6 weeks in order to force the company to look for a local hire. Other than that every time I went to renew it I was there and back in the same day. granted I had to take some time off of work in order to do it but at least it was done in a day.
