Glad I saw this thread. Gessshhh were not alone our last touched was Aug 10, 2006 until now NOTHING :help: We're worried we just sent out our AOS without I-130 Approval but they cashed the checks already. What do you think will gonna happens? :unsure:

I hope we get all our approval soon.

Hi Dezzy&Dan. Please keep us all informed of your AOS application. This topic of submitting the AOS without an I-130 approval has generated some interest on Brtishexpats forum. The general feeling is that you can't do it, and you run the risk of USCIS cashing your check, deciding you don't qualify, sending the I-485 back and you lose the money. I called USCIS my self and asked and they told me I could not file for AOS without an approved 130. Another poster said that at his AOS interview the ajudicator told him he could have ajudicated the 130 at the same time he did the AOS interview. Conflicting stories, confusing info, welcome to USCIS. I've been holding back on applying for AOS until the 130 is approved, but if you don't have any trouble than maybe I'll submit mine as well (I'm not excited about the possibility of losing the money).

well today is the day. we reached the magical 180 days line. i told hubby to call VSC today and after that try to contact the congressman. did i mention that i hate waiting? i cant believe that nothing, but really nothing, happens.

Pssh. You're allowed to contact your congressman anytime and complain...I guess that the theory is, you shouldn't expect the application to be done for six months. But complain away. It was, last time I checked, still a free country.

"you'll get approved soon...don't worry!."..that's good news to me...but the hidden message to me of this cryptical language they serve us on the menu each time we try to have a transparent conversation would be: we have problems internally, we are overloaded, we try to fix it ....(i remember that in november somewhere and if i'm correct, they publicly said they have send around 20,000 K's petitions to Cali because they were overloaded...but, there is still a problem as we all can know in this waiting time...)

As for the "isn't true" reply for contacting a congressman....the hidden msg would be in my opinion: we do not like when people do that lol....

Oh well, i think this waiting time is useful to me: i'm learning a new "language" lol...

Well I hope we've all learned the valuable lesson that you don't get anywhere calling VSC (if I weren't so nice I'd say I told you so LOL). PLEASE friends, as I had suggested a while ago, once you hit the 180 days mark go to your Senator. Don't call VSC, it's a waste of your time. Niagara, don't worry about what they told you-just contact the Senator and let them deal with it. To the rest of us-our day is coming in NO TIME! Get those privacy release forms filled out LOL!

so, my dear friends, I'm back and I don't have any good news!

Hubby called his congressman and he called him back after getting in touch with VSC. The congressman said that VSC has a huge backup (was that the word... it was back-something) and they had to take all people from VSC off their cases and fix the problems, reorganize and retool everything. That is why they have so much work now. But, and this is the funny part, the hope to approve our petition before it hits the year mark!!! Are they kidding? But their goal is to approve petitions within 90 days.... HAHAHA. The congressman said that there is NOTHING we can do but wait. He doesn't recommand me visiting the states but Hubby can come here to see me (because every man has 365 days paid vacation or what???).

Long story short: I'm expecting my visa by February 2008 as NVC wants to work on it too and then send it to the embassy over here.

Does anybody of you has any better news? I'm so frustrated... and I'm glad that I got a new job because I was tired of sitting at home and waiting for my visa.

Well the story continues with Vermont. We filed on July 17, 2006 and received our first NOA on July 21s, 2006....and to date we have heard absolutely nothing since. I've called the processing center and received the same speech that they are working on things from March and that we just need to wait. I did reach out to my Senator who inquired and surprisingly recieved the same communication - yes they have it, it's pending and they are working on a backlog. So no major luck on our end. Plan to reach out to my local state rep next to see what they can do to at least get an update. We need to get this processed finished since we still have to file a waiver. There's a posting on the USCIS site talking about I-130's files starting in July 2006 and later that timing is impacted with the Adam Walsh Child Protection and Safety Act but it's not clear on why this is impacting a spouse visa. Does anyone have any insight?

In short, anyone found guilty of being a sex offender is not allowed to petition any relatives. That covers spouses and not just children relatives. I believe those I-130s they are referring to are mainly the ones being filed overseas. A lot of DCFers (overseas filers) were affected by this abrupt change in policy.

I hope the VSC does something to fix this backlog because I recently filed my I-130 with them.

To summarize: "U.S. Citizenship and Immigration Services (USCIS) advises anyone who filed a Petition for Alien Relative, (Form I-130) with an American embassy or consulate since July 2006 that they do not need to re-file the petition. USCIS is working with the Department of State to process those petitions.

The Department of State announced in January 2007 that certain requirements of the Adam Walsh Child Protection and Safety Act (enacted in July 2006) precluded them from accepting new petitions."

I've just been looking through this thread and I can't believe what I'm seeing. My 130 has sat at VSC since July 12, 2006 with no movement at all and people with dates in August, September and October have approvals?? I'm glad for them but this is getting a bit ridiculous. And what's this about calling USCIS after 6 months have passed? I reread my paperwork and it only refers to them having to complete it in the processing time posted on the web which still sits in March 2006. My wife called the info line and they said the same thing. Am I missing something?

08/02/2006 - Package got sent back requesting a different form (different revision). Proceeded to weep like a girl. Decided against fiance visa with newfound setback. Will wait for December wedding.

02/05/2007 - I-130 sent to VSC and confirmed receipt following day.

02/13/2007 - I-130 NOA1 received

02/15/2007 - K-3 sent to Chicago and confirmed receipt following day.

I just heard back from our Senator's office today and they said the same thing. VSC has a huge backlog and even though our I-130 has been assigned to an adjudicator it will be "months" before it is approved. I'm glad I went the K3 route, at least I'm here with my wife. Hopefully everything will be fixed soon, for all our sakes.

How do you tell if your case has been assigned an adjudicator?

And, is there much of a chance they'll be sending I-130s to other service centers to handle the backlong? I know that occasionally they do transfer them to CSC
