Anyone else here get the good word that they were at the NVC level only to later find that their "expedited" case (due to the alleged NVC-NRC f, up of 4 months duration) was now in AP at NVC?

Is that a generic response they tell everyone?

All hopes shattered again....

Sorry, I didn't have the pleasure of that experience.

Hilarious. We checked the mail today. We got a letter from our Congress woman, saying that they knew my interview was successful and TAKING CREDIT FOR MOVING OUR CASE FORWARD.

The freaking gall. We emailed her office more than a month ago to tell her staff we received our NVC number and no longer required her assistance. We heard nothing back and now this.

Guess who I won't ever vote for? (Aside from the fact her views on certain social issues are diametrically opposed to mine.)

angela is the approval letter with the case number from NVC required at the interview.I have heard that it is but I also hear many people don't receive there letter until awhile after the interview or in some cases don't ever receive it im lost on this?

Vancouver did not ask for the letter. We didn't even get it in time. It was in the mailbox on Monday when we got home with the U-Haul. :S

Well, I just received an email from NVC in response to my inquiry I sent on 28 November:

"Dear Sir/Madam,

The National Visa Center received your inquiry and the attached I-797

Notice of Action - Approval Notice. Unfortunately we do not have a

record of receiving your approved petition from the U.S. Citizenship and

Immigration Services (USCIS). To assist you in determining the location

of your petition the NVC will contact USCIS on your behalf for

information on the location of this petition.

Sincerely,

Jess

Sounds like they still don't have it... NOA 2 was 22 October.

Well at least you got a reply that implies they will help locating your petition by contacting USCIS. I got no offer of help, just a stock answer like many others in this thread have quoted:

Dear Sir/Madam:

Thank you for your inquiry. We do not have a record of receiving your petition. If U.S. Citizenship and Immigration Services (USCIS) approved your petition more than eight weeks ago, send us a scanned copy of your I-797 or I-171 Notice of Action -- Approval Notice. You can email the scan to nvcresearch@state.gov.

Please type your receipt number in the subject line of your email. If you have more than one petition, please send a separate email for each petition. We will contact USCIS on your behalf to find your petition.

Before you send us an email, please check your Notice of Action. If it says USCIS retained your petition, or if it is any type of notice other than an approval, you should contact USCIS. You can reach them at 1-800-375-5283 or on their website at uscis.gov for more information.

Since that email, I did receiver another approval notice dated January 9 stating that the petition has been forwarded to NVC.

I'm not holding my breath!

Now they're saying 8+ weeks?? Wow, must still be a problem then, and hasn't gotten any better since they used to say 30-35 days.

Well, no real valid updates so far this week, called my Senator's office, they sent my I-797 form to the NVC, NVC responded that they have received it and will contact the USCIS to try and get my file sent. So, Senator's office is waiting on that as we are also waiting. I contacted the USCIS Headquarters Office of Service Center Operations today, and surprisingly I got a quick response from them. This is what the email read: "I cannot answer any of your questions. I do know it can take 30 days for the package to arrive at the NVC. The NVC will contact you when they receive the file and are ready to assist you. They are not USCIS – they are State Department." So, it looks like I will be waiting until the end of February to have our petition finally make its way to the NVC. What a nightmare, this is the worst experience of my life, especially since it is out of our control, nothing you can say or do about it, you are at the mercy of others. Not even my U.S. Senator can get a straight answer or solution to the problem, they just told them the same thing they tell us, send us a scanned copy of your I-797 form. I am trying to stay positive, but as each day passes without any answers, your patience, hope, and faith of a happy ending to this process is pushed to the very brink. It is the worst feeling when your fiancé asks you if there is anything new, and all you can say is no!!!!

If your senator or representative cannot get any more information I can assure you that a lawyer in this situation is a waste of time and money. Lawyers do not have access to the system a representative or senator has...

Patience. They system is badly broken and nobody wants to fix it....

I also filled out my ombudsman form, hopefully it somehow helps. Only reservation I have about it is, it states that if they are able to assist us, we should receive correspondence from them to our inquiry within 45 business days! Well, I am hoping my Senators office, NVC, and USCIS can get it sent to the NVC at least in the 30 days after the USCIS requests our case, and relocates it to the NVC. We will see, all we can do is pray and keep thinking positive.

It took them less than a week to reply to me. I attached all the USCIS letters I had received and emphasized how vague and useless the answers were. I don't know if the omsbudsman's involvement helped, but I appreciated their speed and response time.
