NOA2 to NVC: Have you been waiting more than a month?

LOL. I don't believe that. No one on this board has had to wait that long for it to be entered.

I also am skeptical our cases were sent out on December 15th, especially when I got a service reply later that said they'd be sending my file "soon". Nice contradiction CSC. Besides contacting the omsbudsman, I emailed SCOPSSCATA@dhs.gov, which oversees the USCIS service centers. Supposedly they should respond within 10 days...

09 JUNE 2015 - RECEIVED NOA1--AOS/EAD/AP --> ROUTED TO NATIONAL BENEFITS CENTER (priority date)
10 JUNE 2015 - RECEIVED NOA1--AOS/EAD/AP (priority date)
19 JUNE 2015 - BIOMETRIC LETTER RECEIVED
01 JULY 2015 - BIOMETRIC APPOINTMENT (WEDNESDAY)
02 July 2016 - Interview (acceptance) 
10 July 2016 - GC received (conditional)
31 March 2018 - I751 filed (removal of conditions)
10 April 2018 - NOA received for Removing of conditions.

Would attaching NOA2 along with stressing its been more than 60 days enough?

Below is what I wrote to both the omsbudsman and SCOPSSCATA. Since they gave you a specific date in the letter they sent you, maybe wait until January 17th to e-mail SCOPSSCATA (when you can say the service reply was wrong). I'd contact the omsbudsman via the online form now since they take much longer to respond.

On September 10th, 2014 my I-129f petition for a K-1 visa was approved by the California Service Center (CSC). As of today, January 7th, it still has not reached the National Visa Center (NVC). Per the USCIS website, I put in a service request. The first response, which I've attached, said my case was under further review. Besides being vague, that reply did not make much sense since my petition had already been approved.
Consequently I put in a second service request, asking for my case to be sent to the NVC. I've attached that service request reply as well. It repeated what I already knew (that my case had been approved) and then stated they would be sending my file to the NVC "soon" and to give the NVC 90 days to receive my case. Once again, it was very vague. It also ignored the fact that my approval expires on January 9th.
I simply would like my file to be located and passed onto the NVC. The impression I have been given from the service replies, e-mails with CSC, and phone conversations with immigration officers is no one really knows where my case is. To describe it as frustrating would be an understatement.
Any help would be appreciated. As earlier noted, I have attached the service request replies I received along with my notice of approval.

Bow, have you considered contacting your local media? Seems with all this chatter about immigration reform, someone might be interested in a story about the good guy getting screwed.

Might be a good idea. The washington post has reporters that cover each department too. I should look up the person who covers DHS/USCIS.

Someone at the NYT last year (or 2013, can't remember) wrote an article focusing on the marriage visa mess. Some on this board tried contacting her about the TSC v. CSC divide, but don't know if they ever got a response.

it would be 14-21 days if your file got to them it would be great otherwise you have to wait for long long time and there will be no one who wants to help

we have been waiting since noa2 October 22nd. as have the rest of you, I've emailed NVC research and contacted USCIS at the 35 day mark. Just yesterday the nvc sent back an email with nothing useful whatsoever. similar stories to the rest of yours in contacting USCIS. I have called the nvc 2-3 times a week over the last month and during the last few calls have expressed concern over the petition expiring. Tonight, an NVC operator advised me to contact the embassy and have them extend the petition while it is still between USCIS and NVC. This was news to me, any truth or point in doing that?

Congrats on being a part of this exclusive club! Also congrats on having an experience none of us has had so far!

That NVC operator sounds like s/he is great at giving pointless advice. How can the embassy extend the time of a petition they have no record of? That makes no sense whatsoever. Perhaps the NVC person meant reach out to the embassy, ask them to contact NVC to send the petition onto the embassy once the petition arrives at NVC, regardless of the expiration date on the NOA2? Yeah, I seriously doubt an embassy (or any government office) is going to be that pro-active and considerate.

* - 6th Feb - Arrived at Embassy

It is evident that the NVC is in serious disarray and is getting worse by the day despite them claiming late last year they were staffing up to handle the USCIS load. You would think that government officials have been alerted to this mess and would address it. My guess is there is little interest on behalf of those that are able to promote change to do anything. I would further venture to say the majority of America could care less and in fact most would say so what! There has probably been budget cuts on top of the current administration's decisions that do not comprehend the further burden on the current system.

It is somewhat interesting that with all the pain revealed by those trying to get their loved ones through the process, I have seen absolutely no comments in the same regard on Twitter under #NVC or National Visa Center. If everyone involved started lighting up twitter in this regard, possibly it would be easier to acquire news coverage and change.

Our Government, through the actions of the NVC, or lack thereof, is showing complete disrespect for those of us who have followed the process and paid the fees according to their own policies and requirements. At the same time, illegal immigrants are being granted amnesty on the shoulders of the current system even though they have not paid a dime or filed a document and have literally broke the law. Within a month the state of California decided to hire an additional 800 people to process licences for the illegals (no waiting here) yet the government can not staff up to handle the ongoing mess at the NVC.

Not to defend NVC, but it's not the one causing our problem (our=people posting on this thread). Yes, NVC sucks at responding to our e-mails, and waiting forever on hold is a pain, but it isn't the one that failed to do its job (at least not for us yet). We know it is USCIS who is at fault here, and more specifically CSC. Why? Because all but one of us received approval from CSC. Many have been told by USCIS that it has yet to send our files to NVC. If it were a NVC problem, there would be people from TSC facing this issue and USCIS wouldn't be admitting its own failure(s).

And for those who have had this problem resolved (thatangela for example), the NVC stepped up to the plate and handled their cases proficiently.

While I'm sure NVC has plenty of problems and does a number of things wrong, USCIS is to blame in this specific situation.

it's awful for us because we waited 175 for TSC and now we've been waiting for 38 days

it's odd not to have a response or sign where our cases are???

So have you taken any of the steps some of us have suggested?

I am curious about my I-797 approval form. it states right at the first paragraph "The above petition has been approved, and forwarded to the listed consulate..".. which is Lima, Peru

then.. it states again... " Please contact the consulate with any questions about the visa issuance,.

it does not mention anything about NVC... so..what should I do...?

by the way.. 129F was approved Dec 5, and NO2 received on Dec 8..just a month past

We're keeping calling them twice a day

We called USCIS and spoke to tier 2

We called the congressman office to inquire about the fate of our case

all those went in vain and we couldn't get one good answer about our case, all of them said there are a huge load on NVC and you guys have to be patient, whilst the other cases of the same batch got their cases ready and have been sent to the proper embassies. and one of the reasons they said because of the holiday season.

now all we can do is annoying them by calling and they've become more rude and most of the time they hang up the call.

last time they told us to wait for 60 business day not 35 days as they stated in the hard copy of the NOA2.

Waiting is killing us
