Sorry, I know this has come up alot lately, but I intend to file my taxes myself so I want to make sure. This is the first year I have been married. My husband has no income to claim on our taxes. Is it more benficial for me to file married jointly or married separate? Does it even make a differentce since he has no income? I typically get a refund, so I'm looking to get as much back as possible.

Also, this is the first year I've owned a home and will have interest deductions. Will that make a significant difference?

You file the way that is most advantageous to you. If you qualify, most likely MFJ.

YMMV

married filing jointly is the answer. the home interest deductions will help too.

Married, filing jointly will allow you more deductions and yeah, the home ownership deductions will make a big difference:-).

ARodrigues,

Yes it makes a difference. By filing married-joint you get two deductions - yours and his - and the tax rate is lower than married-separate.

Are you sure your husband had no income?

Good question. If filing MFJ, all income needs to be reported. Not just the US income. Of course, some or all of the foreign earned income may be excluded from US taxation. Form 2555 / 2555-EZ will answer how much can be excluded.

Actually, I had not thought of other income from his country..I'll ask him about the specifics and check on that form as well.

Thanks for the help, guys.
