Question abt SSN application form for K1 visa.

HI!

My Wife came on Nov 21st to US 1st time on K1 visa. and on Dec 5th we got married. she hasn't applied for her SS card yet. On SSN application form its asking on Row 5 Citizenship. 2 Legal Alien allowed to work.

3 legal alien not allowed to work. which one shall my wife chose ? its a confusion.

and when can she apply for EAD? before adjustment of status ?

please help me out!

On the SSN application, it is LEGAL ALIEN ALLOWED TO WORK

It is advisable to apply for EAD after you apply for adjustment of status because:

  • There is no fee when filing with AOS
  • This EAD is valid for one year

You can file for EAD before filing AOS, but you will be paying the filing fee and this EAD will expire with your I-94.

Maria is incorrect. A K-1 visa holder is classified as a 'LEGAL ALIEN ALLOWED TO WORK'.

thank you very much. wht documents shall I take to SS office? i-94 printout, passport and her birth certificate? I don't want to change my wife last name to my last name. Also Nevada marriage bureau gave me marriage certificate which i can photo frame. And I can order certified copies online. so Can I take marriage certificate which was given by marriage bureau which was signed by deputy commissioner of civil marriage or do I have to wait to get certified copy to take to SS office?

You only need to bring your passport with visa inside, and the I-94.

thanks I applied my wife for SS Card. they will mail in 2 weeks. after that I apply for her ID at DMV ? and when can I apply for Adjustment of status, Green card and work permit?
