NVC was closed yesterday because of snow, and before I could get through to them today I received an email from the Mumbai consulate indicating they have received our fiance visa case and it is ready for final processing!

We received our NOA2 on Jan 15, so it probably took around 2.5 weeks to process through NVC (give/take transit time).

For anyone who will also be in Mumbai, they include all instructions for next steps either in the email or via links.

Hi!

I have a question about Form I-134:

I make well over the poverty line now, but as of my tax return I was not making enough. On the VJ guide it says that I should just supply 2 proofs of income (i.e. paystubs, letter from my employer). On the USCIS instructions for Form I-134 it states

Submit in duplicate evidence of income and resources, as appropriate:

A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:

1. Date account opened;
2. Total amount deposited for the past year; and 3. Present balance.

B. Statement(s) from your employer on business stationery showing:

1. Date and nature of employment;
2. Salary paid; and
3. Whether the position is temporary or permanent.

C. If self-employed:
1. Copy of last income tax return filed; or 2. Report of commercial rating concern.

D. List containing serial numbers and denominations of bonds and name of record owner(s).

So from this information it sounds like a tax return isn't required or even suggested, right?

So therefore I would just need the following as evidence (since I am not self employed and without a bond):

1. Bank statement with date acct opened, total deposits for past year, and present balance

2. Employer statement

Is that correct?

You are required tax return for the last year or the transcription of the past tax return, by the way; the consulart prefers the transcription more than the tax return. You will also need to send W2 and your paychecks for the last 3 months.

For the TSC cases, I posted this in the November TSC forums but in case you don't see it:

Hi All,

So we contacted the ombudsman to see if we could initiate a bulk transfer from TSC to CSC based on the data on visa community even though we hadn't reached the 5 month mark, to paraphrase from our email:

"Although we have not met the 5 month "marker" we were hoping that the ombudsman would help support the Family Visa Community to find some way of initiating a bulk transfer of cases from the Texas Service Center to the California Service Center and for the Headquarters to better manage the backlogs of Service Centers"

Their reply:

Good Afternoon,

Thank you for contacting the Office of the CIS Ombudsman. Your home state dictates which Service Center processes your application. Transfers are not usually made due to backlog. Processing at the different Service Centers depends on the resources allocated. Our office is currently monitoring posted processing times across USCIS.

As you application is within processing time there is nothing this office can do as this is an office of last resort. You must first attempt to resolve any concerns with USCIS before coming to this office.

I have a question but I dunno if there's a separate thread for this. So, we are planning a 4th of July wedding but that wouldn't be within the ninety day deadline if we finish everything in March and by then I might be able to go back to Seattle with him. Can we ask for an extension of the ninety days? Or can we delay my flight for a month or two?

I don't think you can extend the 90 days term, but im not 100% sure about it.

The only solutions I see are:

1) moving there around middle April so you shouldn't exceed the 90 days if your wedding plan is on July

2) fly over there when you want, do a simple courthouse thing between the two of you within the 90 days and do the real cerimony on the 4th of July

Tax return isn't required but it is used as supplemental evidence of prove of income/employment. I personally used the last 3 years tax transcripts instead which you can download/print free on the IRS site, 2014 w2, 3 months pay stubs, employer letter, promotion letter on company letterhead showing adjusted pay rate, and property tax (proof of asset). Remember your goal is just to prove you are 125% above the poverty line. Whatever combo of evidence to prove that is sufficient. If your income alone is above 125% you're good to go with just proving your income (paystub, w2, ITR/transcript, employer letter, etc)

agreed your best bet is to do the civil ceremony at the court house first just meet the 90 day requirement then you're free to do the real ceremony anytime after. The 90 day K1 requirement is non-negotiable/extendable unless you guys want to start the K1 visa process over again.

Since I do not already have an appointment scheduled does this mean that I will need to wait until a date is assigned to me? Is there something I can do to help expedite that process?

The CEAC status doesn't work always properly. In our case the status changed from "at NVC" to "In transit" on Feb 4 and later (same day) went suddently to "Ready" :mellow: weird.. We thought at first that if the status says ready (= at the consulate), it is ready, but in the end we found out it wasn't and it actually arrived in Naples on Feb 9 (the dhl trick could be useful).

All this to say that even if you read that on your status it doesn't mean you have already an appointment scheduled, but probably the consulate already received your case. I don't know how it works in Japan, in Italy for example you have this famous packet 3 (that from what I heard almost all other countries have) that contains instructions on all documentation to obtain prior to your interview and you should have all these requirements before booking an appointment. In this packet 3 there is an applicant's statement to print out, fill in with basic infos and send them back when you're ready to schedule the interview and when they have your case.

In order to expedite my process I looked for this packet months ago, prepared documents I need, and I had the applicant's statement ready to send once the consulate had my case, and it worked good! I went from their email to inform me they had my case to book the appointment in few hours (I have to say I was also lucky they answered immediately and that the medical in Italy is always the day before the interview).

Other thing, the ds-160 to complete once you know your case is ready at the consulate, but again, I would recommend to look for more specific instructions on the official website of the US consulate in Japan.
