I need some clarification regards to I-130. My wife wants to petition her father with 4 minors children (her sibilings) to live here in the U.S. Does she have to submit an I-130 for each sibiling under 21 years old? or one I-130 form will be sufficient? Also, does my wife have to pay the filling fee for each sibilings too? Please someone help me to understand the process better.

I appreciate your time and help on this.

Everybody gets their own petition.

Does not matter what age the siblings are.

If it is the intent for the father to come asap then he can petition as well and may well be quicker.

Siblings can come with children and spouses.

This assumes she is a USC.

Age irrelevant for sibling applications.

what if the father is the only family left for those minor children from that country? that is kinda odd only the father can be considered an immediate family. the children would be left behind all alone which don't make sense.

Age irrelevant for sibling applications.

hi

it's not odd, parents are immediate relatives and have no waiting time, only time that takes to process the petition, there aren't derivatives in immediate relatives petitions.

siblings are in a separate category and take many years of waiting, depending on the country of origin, they aren't immediate relatives

so if he can't leave them behind, then she'll have to wait to petition her father until the siblings turn 18 and live on their own. or leave them behind with family members

there is only one category for siblings, and the wait is over 10 years, age doesn't matter, nor if they are married or unmarried. the wait is the same

Not everybody is in a position to move countries. Responsibilities could include children or looking after other family members that just make such a move impractical.
