Anyway for my husband to be able to work before getting the work authorization?

Hello,

My husband Mohamed and I went to immigration to get all the green card and work authorization paperwork. They told me that he could not work until he has the work authorization which could take as long as getting the green card (3 months is their estimate). He came on a k-1 visa. I am curious if there is any form that we can fill out, since it is neccesary for him to work. I am a first year teacher and make little. The cost of his green card and work authorization took 80% of my last check from work. Is there some form? Has anyone tried to fill out a form or have had a similar situation, where they needed two incomes?

Any information would be appreciated.

Unfortunately, there is no other way to obtain work authorization.

You must send Form I-765 along with your AOS application and wait for approval.

Most times the EAD is approved before the AOS, but not always.

Sept. 7/05... I-485 & I-131 sent to CLB

Feb. 22/06... AOS Interview - APPROVED!!!!! (Passport NOT stamped)

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

Mar. 22/11.... N-400 sent to AZ

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

You may look into e-Filing the I-765 when filing for AOS, it may be quicker.

I know this must be tough. Definitely file ASAP and within a few months it is very possible you'll have your EAD. You can also probably get the interim EAD if you do not have a card within 90 days. Good luck!

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

I don't think they're issuing interim EAD's anymore. I could be wrong but I think I read that somewhere on here.....

I think you're right. The local offices are not issuing EADs as they used to. Interim EADs now come from Missouri.

However, i would hope that local offices should be kind enough to ask NBC in Missouri to 1) look at your case if it is pending or 2) give an interim EAD.

My experience yesterday in Philly was HORRIBLE. She told me i need to wait for our EAD and that USCIS can take upto 6 mnths to respond to my inquiry to the mis-information line (i asked about my case 6 mnths ago!). She kept directing me to do things I've tried already and was condescending.
