i-134 question

here's a i-134 question:

i make over 125% of the poverty level for my case ...

however, i have very little savings and no real estate, no stocks, nothing like that ... will that matter? or will i just need to show that i am over 125%?

The I-134 whilst not a requirement for K visa's is one thing a Conof in most cases looks at when determining if an applicant will or wont become a public charge.

Overcoming the Public Charge

While an applicant for a fiancé(e) visa is not required to file an affidavit of support (I-134), it is nevertheless useful in proving the applicant is not likely to become a public charge. The Immigration and Nationality Act does require the applicant to establish to the satisfaction of the consular officer at the time of the application for a visa, and also to the satisfaction of an officer of the Department of Homeland Security, United States Citizenship and Immigration Services (USCIS) at the time of application for admission to the United States, that he or she is not likely at any time to become a public charge.

We're in a similar situation and the good people at VJ told us that we should be fine with earning more than 125%. But - at least for peace of mind - considering a co-sponsor would also be a solution.

Having no savings or investments does not matter in and of itself. Neither does the income number, for that matter. One person making, say, 75% of the poverty level may be an acceptable sponsor while another person making 200% may not be.

It's the "totality of the circumstances" that must be considered. (9 FAM 40.41 Notes, N4)
