Does anyone know where I can find information on filing the K-2 part? The K-1 Guide is very helpful, is there any similar information on the K-2? I sent documents to my fiance to sign and I just realized that there may be more documents needed relating to the K-2 that need to be signed. Please help. Thanks.

K-2's will have derivitive status with the K-1. If you are speaking of the initial petition (I-129F) the only requirement is that the child(ren) be named on the petition (regardless of intention to imigrate or not).

I just put my K-2 daughter on my I-129F application. At the interview stage, you will provide documents for the K-2, such as birth certificate, medical exam, police certificates (if over a certain age, which I can't remember right now).

You will be told what documents are required for both the K-1 and the K-2 prior to the interview.

I don't understand. Do you mean that there is no separate form to file for the child? My fiance has four children but we are only filing for one initially. All of the children must be named on his application, right? So how do we differentiate between the one child that is coming and the others that are not (yet)?

You need to understand the the I-129F petition is NOT the Visa application (that happens at the consulate). No seperate PETITION is required for K-2's.

Yes, you name ALL the children regardless of intent.

When you get to the consulate that is when you identify which of the children will be immigrating.

Yes, you add all your fiance's children, whether they intend to immigrate with their Mom or not. My daughter didn't come to the U.S. at the same time as I did. She came a year later.

If any of your fiance's children want to "follow-to-join" (as it is called when they come after the parent), their visas must be approved within one year of their mother's visa. Then, after the visa is obtained, the children have 6 months to use it to enter the U.S.

My K-1 visa was approved June 10, 2004. I entered the U.S. on July 31, 2004. My daughter's K-2 visa was approved on May 26, 2005 (only 2 weeks short of the one year from me obtaining my visa.... that was cutting it close). She did not enter the U.S. until September 5, 2005.

So I have up to 1 year from my fiance's approval date to file the K-2 for the first child? Okay. I noticed that the 129 only has room for three children. I guess I need to attach a separate page with the fourth child?

Follow to join benefits are up to 1 year and applies to ALL the children not just the first one. You cannot stagger the intervals beyond 1 year.

If the form is not sufficient then you attach a supplement.

Yes, you will need to attach a separate sheet to add the fourth child's name to the I-129F. Make sure you put your name at the top of the attachment so that if it gets separated from your package somehow, they know who it belongs to.

I think I need to clarify how the K-2 works. You have to have the K-2 Visas in hand (not just applied for) within one year of the K-1. And all the children's K-2 visas must be in hand before the one year is up, not just one, and then later on another. All 4 children must have their K-2 visas in hand within one year of their Mom's.

I don't know if all Consulates work the same, but for us, the Vancouver, Canada consulate handled our situation like this: I went to my K-1 Visa interview and at the interview, I told them that my daughter was not going to accompany me at this time, but may decide to come later. They instructed me to fax in form DS-230, Part I when I wanted to start the processing of her K-2 Visa. I faxed in the DS-230, Part I on April 6, 2005 and then started collecting the required documents (which the Vancouver Consulate had instructed me to obtain), such as the medical exam, her police certificate, long form birth certificate. I requested an interview date that worked for us (because I had to return to Canada to take my daughter to her interview at the Consulate). Fortunately, the date I requested was available and we went to her interview and she was approved.

You will need to ask at your fiance's K-1 interview what she needs to do to start the K-2 process for her other children that are not coming with her at the same time.

Okay, I have a better understanding now. It was not my intention to file K-2 visas for all of my fiance's children, just the oldest one. My intention is to file for them as stepchildren at a later date. I would be too overwhelmed if all of the children came at once. Is there an additional filing fee for the K-2?

There is no actual "filing" fee for the K-2, but there are expenses involved with it. There is the cost of the medical exam in her home country, as well as the cost of obtaining the police certificates from her home country, the long form birth certificate, passport photos, and then the $100.00 (U.S.) Visa Fee at the Consulate the day of the interview.

Then, there is the usual AOS fees, once she arrives in the U.S.
