No Indictment for New York Police

he had in fact been arrested in the past and should have known to immediately drop on all fours upon being spoken to by a person in uniform.

Exactly. He would still be alive if he had not resisted.

At first, my reaction was "How can they not indict him after seeing that video?"

But the more I thought about it, I don't know what other options they had. When a police officer tells you to put your hands behind your back, you do it, no questions asked. If you think you are being arrested illegally, you can argue that point later, but not while they are trying to handcuff you.

NYPD (and all other major city PD's) procedure calls for the cop to go hands on once the subject is informed that he is being arrested and refuses to comply with an order to put his hands behind his back or exhibits any kind of aggressive or offensive motion. By "Hands on", I mean he is taken to the ground as quickly as possible and lays flat on his stomach. The cop has a lot more control/leverage over a subject when he is laying flat on the ground versus on his feet. For this reason he was taken down to the ground, or at least they tried to, and the fact that he was huge left the cops no choice but to take him down by his neck. Good luck taking a guy his size down to the ground any other way. If it was only 1 cop instead of the whole group, he would have gotten shot.

If the cops used a taser, that probably would've worked, but very few cops have them. The big guys are less resistant to them sometimes.

It doesn't matter what he was being arrested for, he resisted and became combative. He didn't deserve to die, but he brought it on himself. If he turned around and surrendered to the cops, it would be over and he'd be alive today. Let me know if you disagree with this.

no. you don't know that. they did absolutely nothing to help him when he was cuffed and unconscious on the sidewalk.

You are saying that only to start an argument. Some people just want to argue, especially about race. If he peacefully surrendered and didn't run his mouth and be combative, they wouldn't have needed to chokehold him. And no doubt that he'd be alive today.

At what point during the video did they say you're under arrest?

There's a lot that you don't hear on the video. Whether he was or wasn't officially under arrest is irrelevant. The fact remains that he disobeyed a direct order from a police officer and needed to be taken down. He shouldn't have resisted. The genius actually thought he would outmuscle 12 cops....

Just a nice guy on the street, who was approached by white police for no reason. Damn, those white people. Damn them!

I've been arrest a time or more. I've never been told I was under arrest until I was cuffed. ever. I've been told to stop resisting, gimme your arm, stop biting you !@#$%^&*%$#@, etc. but, never 'you're under arrest' until I was cuffed.

eta: then you're given the Miranda rights.

ALBANY — Gov. Cuomo is out to kick cigarette smugglers in the butt.
In an effort to crack down on the sale of illegal smokes in New York, Cuomo is set to announce Monday a 13-agency task force dedicated to keeping illegal cigarettes out of the state.
“This new law-enforcement strategy will help to crack down on these illegal cigarette sales and capture those smugglers who seek to evade the law and rob the state of the revenue it is rightly owed,” Cuomo said.
A recent study by the Tax Foundation revealed that almost 57 percent of cigarettes smoked in New York were bought into the state illegally, the highest of any state. That was a 20 percent increase from the previous study, conducted in 2006.
New York state has the highest cigarette-tax rate in the country, making trafficking a profitable and attractive enterprise.
