One problem solved! I think you will need to register the births, etc. at the closest U.S. Consulate to you. Get your wife to give them a call.

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

My wife is American by birth and we have been married here in Canada for 8 years. We have 2 small children born here, ages 1 and 3. My wife wants to move back to the US to be closer to her mother. She now has the opportunity to get a job 20 mins from her mothers house paying quite a large salary(!!). What would be our best/fastest option for the entire family to move there? We would be living at her mothers house.

- Do we file the I-130 here before she leaves?

- Can we all go, and then file the forms in the US providing I come back every 6 months for a bit?

- Can the kids stay with her as well?

I'm trying to find a solution that means the least time seperated from my kids. :(

The "high paying" employer may assist her with the problem. I would check with their human resources department. They may assist with an employment based visa.

Yeah, they're not going to help me any :angry: Looks like we'll have to apply for Claim to Citizenship for the kids (form N600 yay! $255 boo!) and then the I-130 for me.

Hopefully they'll process your kids' claime to citizenship in a speedy manner. As for you, get filing on that K3! :)

The I-129F, used for a K-3 spousal visa, is historically faster than the I-130. It spends less time at the NVC, so it will get you into the country faster. However, you will have to adjust status after you've entered. Yes, you can file an I-129F for your wife, but you must first file an I-130 (because they like to take as much of your money as they can ;) ).

From reading the forums here, I've come to believe that filing an I-129F petition also speeds up the I-130 petitioning process. This is far from a scientific observation, though, so take it with a grain of salt. :)
