Greetings,

I just sent away my I-130 (I'm the USC) for my wife's daughter in Thailand (8 years old).

The instructions for the I-130 said nothing about sending in a copy of the child's birth certificate. I sent in all other evidence as stated in the instructions with the PDF (my passport copy, marriage license, etc).

When I applied for my wife's K1 the child's BC was included as part of the evidence during the interview at the embassy.

My question: is the CSC going to RFE because of this? Will having supplied a copy of the BC for my wife's K1 be good enough? Will the BC simply be required at the embassy when it comes time for an interview?

And, if I made a boo-boo here can I send in a copy of the BC before they RFE me?

Dear Oregon,

In the I-130 instructions under number

"7. What Documents Do You Need to Prove a Family Relationship?"

it says

"C. A child and you are the father: Submit a copy of the child's birth certificate showing both parents' names and your marriage certificate."

Later, the USCIS will want permission from the father listed on the birth certificate for your stepdaughter to come to the US.

At this point, I don't know if you can submit the birth certificate until you receive an RFE, especially since you don't yet have a case number.

Hopefully, you'll hear from them soon.

I filed my I-130 a couple of days ago for my stepson.

The problem is that the section in the PDF for the I-130 reads like:

A or B or C or D or E....

In the stepchild section they should have included BC as well since they mention the marriage license again.

I figured something was missing but the instructions for the step-child section seemed complete.

Oh, well, I managed to get the USPS to recall the envelope so I can add the BC.

Each petition needs to "stand alone", you cannot reference or rely on evidence included in another petition to meet the requirement.

Oh, well, I managed to get the USPS to recall the envelope so I can add the BC.

Yes, you can go to the Post Office and fill out a form called a 'recall form.' If the item has not been delivered then the destination Post Office will likely be able to intercept it and return it to you.

I literally got it back within 30 minutes of having it nearly delivered since Nebraska is 2 hours ahead of Oregon. This means I got to the Post Office here at 8AM and they could stop it at 10AM in Nebraska just before the mail left for the NSC.

Good tip to know.
