Hello - I am petitioning for my husband's green card and am curious if anyone's found a good guide on how to fill out the Affidavit of Support if the petitioner has no income. My father is his joint sponsor and I want to make absolutely certain that these forms are all correct and will not cause any delay after the interview

Here's a sample form for you http://www.visajourney.com/examples/INS-Form-I-864.pdf

You would of course say unemployed and $0.00 income.

Dad's would be similar, but he would check 1.d. I am the only joint sponsor

His household size might include a wife on Part 5 #3

or dependent children on Part 5 #4

If he has a wife and wants to include her income, she goes on part 6 Person 1. If he lists her income, then she fills out form I-864A.

If he makes enough on his own, then he doesn't have to list her, but a joint tax return is not enough for USCIS to know what part of the tax return is his and what is hers. It is all lumped into one pot on a tax return. So he should get an employer letter stating his annual income and some pay stubs too.

He also submits proof of his US citizenship or permanent resident status.

There is no better way to understand the form than by reading the written instructions about three times as you follow along on the form. Then you won't miss any details.

Thanks for the help - I have filled out mine but just wanted something to check it by since we don't have the help of a lawyer this time around. We cannot have any delays due to our paperwork mistakes! :)

Also if you have no income means you haven;t filed taxes so just write a short statement and attached why you weren't required to file taxes. Unemployed.

I am in a similar situation, but I have been unemployed since 2007. I am the petitioner, and have no income as a housewife other than a Canadian Tax Benefit. My wages were not in USD, either, as I have been abroad for 10+ years. We have included a signed (by me) letter of explanation of when I stopped working, that I have no income other than a child care benefit in Canada and that it will no longer continue upon us leaving the country. I also back-filed my taxes for three years and included copies since tax transcripts are not available yet.

We included our assets that are well over the 3 year amount needed (IR1) and all the documentation that goes along with it, but we have a joint sponsor as well in the case that they decide our assets are not acceptable.

I am only at the stage of submitting, though, so this is only what I have done to give you information and ideas, not suggesting as advice on what to do in your case. HTH

When you say you have assets over the 3 year amount? You need assets X 3 for the # of household. So if your household # of people is say 2 thats $19664 you need 3 times that to qualify with assets. (Hope I didn't confuse the whole thing).
