we are soooooo confused! we need help on our visa application

ok, i am married to a US citizen. I am a filipino citizen who is currently visiting here in canada. We got married here in Vancouver, last year December but im really from the Philippines. My husband got a mail telling him that they received our I-130 application. So we are working on our I-129f form but for some reason, we don't know what to start and what to do. Cause as what we know, to apply for a K3, it should be where the marriage took place. We just want to know if i, being a filipno citizen, do i need to go back to the philippines? or i just wait here in vancouver and apply from here. Please help us!!!!!!!!!!! All your advices wiill be of great help for us cause we miss each other soooooooooo much! my husband is in the US army and i just hope we will be together again soon. I LOVE HIM, HE LOVES ME! we love each other!!!!!!!!!!!!!!!1

I suggest that this might be better answered by a consutation with an Immigration attorney....Sorry I can't be much nore help.

I hope this is helpful to you. I married a Chinese citizen on November 23, 2006 in China. On December 6, 2006 I filed the I-130 Form to the required office in the USA, which is determined by where I live in the USA. In my case, it was the Vermont Service Center. I soon received the I-797C Notice of Action that told me the application had been received. The USCIS website is not clear in its instructions as it says to wait for the I-797 Notice of Action (not the I-797C). It took a telephone call to the USCIS 6 weeks later to learn that the I-797C that I received was what I needed. 6 weeks wasted!

When notified that the I-130 has been received and you have a case number, that copy of the I-797 or I-797C then needs to be filed along with the I-129F application (and additional fee), to the Chicago office. Then the waiting game begins. You do NOT file in the Phillipines, the applications are sent to US offices, then forwarded to the US Consulate in the Phillipines.

I suggest you search the USCIS website for instructions.

You WILL need to return to the country of marriage for the interview and receipt of your visa. The paperwork will be forwarded to the US Consulate in the country of marriage for further processing. If there are several Consulates, then it will be sent to the one with jurisdiction over the city where you were married.

i hope someone can help us...

I know it's confusing and frustrating not knowing what to do. Just be patient and I'm sure someone will be able to give you some advice/guidance soon. The K-3 section doesn't receive the traffic the K-1 forum gets. ;) In the meantime, try doing some reading on the process. Just use Google.com and search for things that apply (K-3, 3rd country, vancouver, etc, etc).

Edit: Ah, and ChinaDavid was replying at the same time as me. So it sounds like she can just stay in Vancouver to wait for the process to finish? That's probably a good thing given the long waiting time at the US Embassy in Manila.

That's what it sounds like from reading the instructions and the LIFE act, but as a citizen and permanent resident of the Phillipines, wouldn't she still need to do the CFO seminar regardless of where she filed? Or no?

First you need to file the I-129F. The I-129F is the petition that when filed along with the I-130 will constitute it a K-3 and that will be adjudicated in Canada ( the country in which the marriage took place)

As far as your ability to remain in Canada during the process ; well that would be up to the discretion of the Canadian Govt. For some reason I wanna say the consulate will want proof that you are in Canada legally.

I came here in canada to visit my cousins and my grandma. I am always here legally. as a visitor, every other year. My husband came to visit me here, he proposed and next thing we know, we got married! we just want to tie the knot because we are soooooooooooo in love. And we have been gf/bf for a almost a year.

Without a doubt, i really wanna go back home - to the Philippines, as i just hate the weather here. The only reason why i am still here is because I am confused wether to wait for my k3 - for my interview or i can do it back there. ChinaDavid, thank you very much for the information. I really appreciate it. And to the others, thanks as well.

As you can see, I'm still trying to wrap my head around the CFO thing! :P

For the OP, it looks like you are interviewing in Canada. How long it takes for you to get your I-129F approved, etc. depends also on whether your I-130 is at CSC (California) or VSC (Vermont).

How long is your visitor's visa in Canada good for?

Pre-Departure Registration

Filipino emigrants or those leaving the country to settle permanently abroad are required to register with the Commission on Filipinos Overseas (CFO). Part of its registration requirements is attendance in the Pre-Departure Orientation Seminar (PDOS) to prepare them for settlement overseas. Those who are 12 years old and below are exempt from attending the PDOS. They must, however, be registered, even if by proxy. Children of emigrants, aged 13 to 19, are required to attend the Peer Counseling Program to help facilitate their adjustment to a new environment.

The registration of Filipino emigrants started in 1981, or a year after the CFO was created. The registration process generates an information resource on Filipino emigrants, which provides reference for policy formulation and program development.
