I am just trying to figure out your situation before i can offer any advice, it sounds like you are waiting for your k-1 in spain but you need to travel to the U.S. to visit your other half, sorry to hear he is in the hospital. I dont see how this would difficult your application process if you are able to travel freely from one country to the other

Make sure you have strong documentation showing your ties to Spain - letter from your employer stating the date you'll return, bank accounts, rent, etc. Don't bring too much stuff with you when you go that could make you look like you're planning on moving. There's a POE in Ireland (Dublin, I think?), I suggest transferring there. At least that way, if you have a problem with a border patrol officer and can't get into the country you have to fly back to Spain from Ireland... not the USA.

If you explain the situation to the border officer and take lots of proof of ties to your country, showing that you intend to return after you visit your fiance in the U.S., you probably will have no problems.

You should take lease/mortgage papers, your most recent pay stubs, letter from employer stating date you are expected back home.

You could also try to get a letter from your fiance's doctor faxed to you to show at the border to prove your story.

Good luck.

You *could* have a problem (with papers in progress or not) if the CO at the point of entry is concerned that you have immigrant intent. Therefore, follow the advice provided and bring as much information as you can to prove that you will return to your country after your visit. Answer only the question they ask and do not volunteer the information that you have an I-129F in process if they do not ask you.

There is no-one to call on the phone to get a straight answer on this - don't waste your time.

That's why we're advising you to bring proof of ties to your country. Having a fiance in the US gives them reason to be suspicious that you could be planning on moving here illegaly rather than visiting, so you have to be prepared to show proof that you DO have reasons to return to Spain. ;) And like I said, transfer in Ireland so you feel better, knowing that you'll have your answer as to whether or not you're allowed into the country before you cross the Atlantic. :) Can someone confirm my memory on that, is it Dublin that's the US POE in Ireland?
