Timeline

The release can typically be found on the website for your congressman. Some will ask you to print, sign and mail it, others will have an option to fax it. Either way, without them having a signed authorization from you, they are not able to do anything for you. One would think they would have at least responded to you email to tell you that.

As for who you email. I'm not sure it matters much at this point as you have already sent your request. I would not email the embassy as I have found some will automatically deny your request if you don't follow the appropriate channels. As for involving the congressman, that's up to you. You have already sent the expedite request to the NVC, so I don't know what more they can do for you, unless it becomes a matter where you find it taking an extremely long time to get a response.

We are terribly discouraged to be following all the rules and minutia and for it to take so long. 9 months and counting.

To my understanding I-129 dont go through NVC process. So yes 9 months is alot. We will have a year next month but have 4 months in nvc with their 60 day backblog and now additional 60 day wait for a checklist our attorney cause. But stay positive we will all get over this nightmare immigration process.

I got a case complete on last Friday(actually Thursday US time) but yet still no case complete email from NVC. Also was wondering when I expect to get it.

Hello everyone,

I sent my AOS and IV together to NVC last week, when I filled out I-864EZ form (I am eligible) I noticed that sending last three years of tax transcripts is optional, so I just sent last years tax transcripts. I am not sure they if do check list for not sending additional 2 years tax transcripts? Should I just send all three years again? thanks for your advice.

I was hoping for case complete but now have the following items on my checklist.

In Part 6. Sponsor's Income and Employment, please correct the following...

[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal

income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

1) I thought income is zero as ALL of my income is from a job I have in Australia. The income will not continue after we leave Australia.

The Form I-864 we received was missing the following page(s). Please ensure you include all nine pages when you resubmit the form.

You must submit the following financial evidence:

[x] Proof of current employment (examples: a recently dated job letter, pay stub, or a copy of your business license). [x] __________2013_________________________ W-2 forms(s) or IRS Tax Transcript(s).

2) I definitely sent my 2013 tax return. It is in with all other tax returns, and states I have zero income as it is from a foreign source. Do I need to resend or can they just look at it again??

And lastly, we have this: The NVC has received the information you have submitted in reference to the Affidavit of Support. Please be advised that the Affidavit of Support information you have provided does not appear to meet the minimum income requirement according to the current poverty guidelines to sponsor the intending immigrant(s) for this petition. The consular officer will make a decision regarding this requirement at the time of your interview. In order to avoid delays, you may wish to submit an additional Affidavit of Support (Form I-864) for a/another Joint Sponsor to the National Visa Center to assist in sponsoring the intending immigrants. To view the current poverty guidelines, visit http://www.uscis.gov/files/form/I-864P.pdf.

If you decide to use a Joint Sponsor to assist in sponsoring the intending immigrants, please note that you the sponsor may not use Form I-864EZ and will also need to submit Form I-864.

3) the sponsorship requirements state you can use income, OR assets if you do not have usa based income. We have well over what they want in assets, yet we need a joint sponsor? Then why do they offer it as a choice? I don't mean we just break even for the assets, we are comfortably over. Why is this not acceptable?

4) will these 3 items hold our case at NVC or will it go to interview still?

5) if we are held at NVC can I ask to submit information electronically? To post from Australia will take 2-4 weeks, plus 60 day NVC review, then another few weeks to two months before interview, this is crazy?! So many illegal people can get in yet we try to do it right and get so many problems with immigration.

I am so annoyed, as I plan on going home early February and I was praying my husband can come too. But now he can't so I will go alone. Plus we have just found out we are pregnant and I want to be in usa with my family, but I also want to be with my husband. This is terribly unfair. And it isn't like we just met, we have been together 8 and half years, married for three. Now we would like to live near my family and help with my aging grandparents. Why must it be so hard to get this across to usa immigration.

We will ask someone to be a joint sponsor, but again, all of that paperwork will take a few weeks to get to Australia if posted, then for me to post to nvc, more weeks again! :( sorry to winge, but it am very sad. I hope this will have a happy ending.

I apologize for everyone who has been waiting much longer than us, and those who are separated. It must be terrible for you. :(

I am happy to provide my interpretation, however I am currently awaiting review of my AOS, so it's possible I too have misunderstood some aspects of the process.

1) It sounds like maybe you're getting current income and recent years' income mixed up. Your current income is entered at Part 6 Item 5 - I am unsure of the exact guidance for what to enter here if your income won't continue once you enter the US, but we just entered my wife's current income, as that's what it's asking for - I figure it's up to them to make a determination whether it will continue or not.

The income you list at 13.a.1 must match exactly what is listed for total income (or adjusted gross income, depending on which form 1040 you filed your taxes on) on your tax return. This may be 0, but it may also be non-zero if you had other reportable income during the tax period (e.g. interest, dividends). My wife's US tax returns since we've been living in Australia have all had small amounts in total income.

2) It looks like you're missing 2 documents here. One is your proof of current income - i.e. substantiating the figure you entered at Item 5. For our application we supplied a letter of employment, and it was here that we disclosed that the income would not continue on return to the US. The second document missing is a W-2 to go along with the tax returns you submitted. As all your income has been from Australia, you won't have any W-2s, but what other people have done is submitted a letter explaining that all income was from foreign sources and hence you have no W-2s. However, is there a reason you didn't submit an IRS Transcript? This seems to be a more fool-proof way to go, as it includes all information that was submitted with the tax return, hence no need to worry about missing documents.

3) This one has come up a couple of times so far this week - it seems to be a standard response whenever someone tries to qualify using assets rather than income. Note that the checklist doesn't *require* a joint sponsor, it just suggests one. If you believe you comfortably qualify with your assets, then you have the option of taking no further action - the consulate will review the evidence you submitted of your assets and make a determination whether they believe you'll be able to support yourself off them.

4) Your application will be parked until you submit a response to the checklist with the requested documentation and amendments, and you'll be facing another ~60 days wait for the checklist response to be reviewed.

5) Electronic processing is only for a select few consulates, and unfortunately Sydney isn't one of them. If you're really concerned about mailing delays, Australia Post has a couple of express international options, which have the added benefit of being trackable so you can ensure the documents get delivered. We've used the Express Courier International option every time we've had to send something, and it's worked really well.

Have you filled part6, Q5 with 0 ? NVC rep adviced to my wife that she fill that part with 0 because her incomes won't continuing after she moved. Also 13.1.a is 0 ( same is in the tax transcript under totall income)

I am happy to provide my interpretation, however I am currently awaiting review of my AOS, so it's possible I too have misunderstood some aspects of the process.

Thank you very much for taking the time to reply, I will double check if I should have anything for gross income over the next few days and if so I will adjust it and resend. I don't have dividends,interest etc, as that is in hubby's name.

I did send the 2013 IRS tax return and I also sent a letter regarding my income being from Australia and not usa. That's why I am annoyed they are asking for it again. If they look through what I sent they will see it. I will resend a copy of my tax return anyhow if I have to resend the i864.

I also used express post with Australia and with a tracking number, it still took 3 weeks from perth and cost over $80! I might as well send normal as letters usually take 2-3 weeks anyhow. That's what makes it more annoying as it will put us back so far.

So if it is only suggested to have a joint sponsor, if we have one,must we submit the i864 for the joint sponsor to NVC or can we talk a copy to the interview as a backup? This would save time so that family can send to me instead of to NVC and maybe get another checklist for it.
