Hi all,

We are updating the AOS package since they have requested us to bring it to the interview. Our situation has changed since the time we sent the first package and the petitioner is living at her parents' house. Her father is the joint sponsor and we were wondering if he should use the I-864 or the I-864A form instead.

On Saylin's wiki you can read the following:

"The I-864A is used for household members of sponsors. Typically, the only time I recommend using the I-864A is for spouses of joint sponsors who are deciding to contribute their income as well. So, in these cases, the petitioner would file an I-864, the main joint sponsor would file an I-864 as well, and then the joint sponsor's spouse would file an I-864A."

But on the I-864 form you can read this:

¨Part 5. Sponsor's Household size

7. OPTIONAL: If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here."

So, since the petitioner and the joint sponsor are living in the same house... Should the joint sponsor use the I-864 or the I-864A form?

The petitioner and joint sponsor are not combining income so the joint sponsor should use the I-864 form.

While they may be living at the same residence, what I stated in the wiki is still my opinion on the matter. I only ever recommend using an I-864A for spouses of a joint sponsor.

In your case, I'd suggest an I-864 from both the petitioner and the joint sponsor.

update so apparently they are taking a month to just scan your mail in the system they kept telling us that they never got our civil documents when we sent them on nov 19th. finally yesterday i got email saying that they got them and wait 60days. this puts us back 3 months now. this is so unfair. when we do our best to reply to all their demands its ridiculous that they take months at a time to just open your mail. i called NVC they were basically like we cant do anything sorry...... :ranting: :ranting: :ranting:

It seems that NVC has picked up the pace somewhat. Praying for all of you here, that you have some good news soon. I know how frustrating this process is. I have been one of the "lucky" ones who hasn't run into any bumps in the road. My heart goes out to all who end up bogged down in the process due to tiny mistakes and "lost" paperwork. It is so unfair.

I am on hold now with NVC. I remain skeptical until I hear them confirm that my case is complete. Will update as soon as they talk to me :)

It will be interesting to see if they give us the same interview date!

For those with Indian passports, do we have to include both the page with photo/passport no/issue date/expiry dates AND last page that contains parent's/spouse's name as part of Biographic page of Indian passport for NVC?

I know how upsetting and frustrating having your expedite request denied is. Mine has been denied by Cairo as well. I don't know what your reason is for requesting expedite is, but if it were me, I would try again.

I'm currently in the process of drafting a new cover letter for requesting expedite again.

Good luck! Don't give up hope!

I requested an expedite to Santo Domingo embassy last week. Got an email confirming they received it and can take 3 days for them to look at case. But have not heard anything after that. If you contact your senator or congressman, you will typically need to sign a release form before they will assist you, so that might be why you have not heard anything yet.

As for the response time, it varies. My first request was sent by the senators office, they have a special congressional unit they communicate with from the NVC. The typical response time from them, just to acknowledge it has been received is 2 weeks. If you email your request directly to the NVC expedite email, you will typically get a response within a day that they have received your request and it is being processed. From there it can take anywhere from a couple of days to a couple of weeks before you actually get a response. My most recent email was forwarded to the embassy in Cairo on 12/17 and on 12/18 the embassy notified the NVC that they denied my request, however I have not been notified of this in writing. I was given this information over the phone by an NVC representative when inquiring about something else.

Expedite request is very hit and miss at this level. Not like the process at USCIS which was pretty clear cut. It is the embassy that makes the decision as to who gets expedited and who does not. It seems as though there are no set guidelines, an they have every ability to say no, just because they want to. Some embassy's will expedite cases for the most trivial requests, and others will not expedite even if someones has a life threatening condition.

All I can say is be patient, hang in there. If you have not had a response within a week, you can always call NVC to follow up.

Thank You for the response. The release form for congressman is obtain how? Do they send it to me after they read my request? Or I have to obtain it before my requested? And how? I email all 3 separate NVC, Embassy and congressman. I think the email response may have been from nvc. I will call them tmw. It'll be a week on Tuesday. Maybe they know something.

It only took a few days, the congreman's office said they could not do any more to help us. We did have to fill out a release form and send a letter. I guess we did not sound desperate enough, but you always have to try.

Thank You. I will wait on congressman to see if I get a response or any word on the release form. Im just hoping the embassy gives green light to NVC for the resquest. The wait and process in NVC is totally incredible.
