Should i wait to file taxes or have a co-sponsor?

Hi everyone,

Sorry if this post in the wrong place for i'm new here!

To get to the question or the dilemma... We were approved for the K-1 visa and have been contacted by the embassy to provide necessary documents. We were thinking we will get to that step after that i have filed taxes for this year, but our process moved faster (not to complain lol). I didn't file taxes in 2013 because i was still in college and was claimed by my parents. However, i graduated in May and i have made enough to get me over the poverty guidelines for 2014.

So should i wait till i file my 2014 taxes on 01/31 or should i submit the documents now if I have a co-sponsor who is making well above the poverty limit? By the way, the co-sponsor is a family friend, does that matter as well?

Depends on what country the beneficiary is from. High fraud consulates rarely accept co-sponsors whereas in low fraud countries (European VWP countries, Canada, Australia, New Zealand) it most likely wouldn't cause problems.

He is from Sudan and the interview is in Cairo. A relative just went through the same thing and they had no issues with having a co-sponsor. The difference in my case is I haven't filed taxes for 2013 because i made very little. Should i just wait 2 more months to file taxes?

Were you required to file a tax return per the IRS guidelines or not? You will need to PROVE that you were not REQUIRED to file a tax return last year. Being claimed by your parents and not making enough money will only work if you show based on teh IRS rules that you did not have to file a teax return. Otherwise the USCIS will wnat to see a tax return from last year. Filing a tax return and owing taxes are two seperate things are far as the USCIS is concerned. They want to see a tax return from the primary sponsor becuase they believe that everybody must file a tax return. So now you have to prove that you did not have to file last year. Go here and see. The USCIS wants proof of current income like pay stubs and/or a letter from you employer to show you make over 125% of the poverty level. You tax returns only show that you filed taxes and may show your earning history.

There is a form i forgot its name but i will be getting from the IRS this week which shows that i did not make the amount that would require me to file. So, will a letter from my employer be enough if no taxes were filed? Thanks for your response and time.

Both Sudan and Egypt are 3rd world & high fraud countries, your case will likely go through extra scrutiny.This means, even after an approved interview your fiancé will probably go through weeks or months of Administrative Processing (AP). It happens in 90% of the cases when the beneficiary is a male and lives in a high fraud country (especially Arab and African countries!). If I were you, I would wait 2 more months to file the taxes, I wouldn't risk having a co-sponsor at a high fraud consulate. Just because a relative went through the same and they had no issues, it doesn't mean that your case will too. Every case is different, just sayin'.

Thank you for your advise. I went by it and decided to wait. I will be filing my taxes tomorrow and sending everything afterward.
