hello everyone , just got my denial letter , and ill like you guys to advise me thanks.

i became resident on 02/13/2006

i got a arrest on 11/13/2009

i apply for citizenship on 03/26/2014

this is what is on the letter of denial:

during the interview of you application with a immigration officer you testified that the information on your form n400 ,along whith the amendments made during the statutory period of march 26 2009 to the present you were arrestedon november 13 2009 and charge whith domestic violence in violation of florida statute 784.03 on july you recived an adjudication witheld decision of the domestic violence and sentenced to twelve months probation enroll in anger management program and pay all court cost and fines in addition you were requerided to meet all of the conditions of you probation in eleven months , it is

noted that you provided copies of all documents and receipts and other related forms relating to the completion of all condicion of you probation.

to be eligible for naturalization you must demostrate that you a person of good moral character. additionally you have not established any extenuanting circumstances that would warrant a departure from this finding. you are ineligible for naturalization at this time .see INA101 (F) AND 316 (A) (3)....

NOW MY CUESTIONS IS

WHEN CAN I REAPPLY ?

SHOULD I REAPPLY?

I BELIEVE I APPLIED LIKE 8 MONTH BEFORE THE STATUTORY PERIOD OF 5 YEARS OF GMC

PLEASE HELP ME WHITH THIS .... THANKS

You need to file an appeal first (Form N-336) and you should do this quickly because you only have 30 days to file the appeal. You have two options: file the appeal or, send another N-400 - depending on the wait times for your district office, sometimes filing an N-400 is faster. Remember, USCIS must receive your appeal before 30 days of the decision if you want anything done.

To be honest, I would get a lawyer. Domestic violence is very serious and some people do not naturalize at all from a conviction like that.

Well seems like the biggest thing you didn't convince is what they said. What exactly did you provide to show you aren't hat person in 2009. You need a lawyer.

You should checked with a lawyer before you filed. I would consult with a lawyer about when you might be eligible

It seems that you applied too early. If you need to speak to an immigration lawyer about it you can do so for $15 instead of paying lots of money to a lawyer and getting the same answer. I agree with several of the posts suggesting the help of a qualified attorney. Normally, I would never suggest an attorney but because of your Charge "Domestic Violence". Domestic Violence in the U.S. is now a very serious offense almost as serious as a felony. Even if it is downgraded to a misdemeanor assault, if it has the words domestic violence anywhere in your case, you will need professional assistance.

In the State of Texas, Domestic Violence can not be removed from your record, even with the help of an attorney!!
