Hi everyone, I have a few questions about the I-864 for AOS:

1) We have a co-sponsor because I am a student & all I currently have is a part-time job where I work two days a week, do I need to include this on the i-864 or could I put unemployed or leave it blank? I've only been working there for a few months and do not have an annual salary or anything.

2) My dad was the co-sponsor for the K1 process when he was employed and he is currently unemployed with a year's pay from his last company that he just ended in Oct. He essentially has the next job lined up but because of all of the processing he is technically still unemployed. Will this affect his ability to be the co-sponsor?

You need to include all the evidence for yourself--i.e. tax transcripts and employment and wage history. SInce you need a co-sponsor, that person needs to make 125% of the poverty level for a family of 3 at the time of filling--i.e. needs pay stubs, letter from employer, and tax transcripts. It is always current income that matters. I would wait until your father gets the new job and has a few pay stubs as proof. There is no real deadline for filing the AOS unless you happen to live or travel near one of the interior CBP checkpoints and then they MAY give you grief for being out of status. Also the foreign spouse cannot work or return from international travel until the AOS is filed and the EAD/AP and/or GC are received, so their life in the US is on hold.
