Im confused about working with out EAD but have NOA, i read in other forum that you can work even you dont have EAD as long as you have you NOA or you can work with out EAD as long as you talk about the employer about your situation. If we can work with using the NOA as a proof that your EAD is pending, what will happen to the interview of your AOS? do the interviewer will not deny you that you work wiht out the EAD?

The NOA is acknowledgement of receipt of the filing and does not give authorization, at least that is the way we understand it. The EAD is just that, employment authorization document. The NOA is just that, Notice of Action.

The above post is correct. A NOA just acknowledges that the 'CIS rcv'd some type of application and not that it's been approved.

In other words, you cannot work until you actually have an EAD card in your hands. Having another NOA informing it's been approved will not do either.

They are not enough -- you need the card to show work authorization.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

I think you can work if you have the NOA which states that your EAD was approved. You can show that to an employer and they can hire you, but you would have to show them you have the EAD card within a limited number of days after your employment, I don't remember how many days do they give you, maybe about 2 weeks or something. However, if you only have the first NOA which just states that uscis got your EAD application for processing that is not enough to be eligible to work.

Timeline

This does not apply to the OP's situation, but an NOA1 is sufficient to continue working while a RENEWAL EAD is pending. The OP is applying for the first EAD, so an NOA1 is insufficient.

You can also look for work and interview before you have your EAD, I believe, as long as you don't actually start working until you have your EAD. Some employers, from what I've read on VJ, will be understanding in waiting for a while if they want to hire someone whose EAD hasn't come through yet.
