DCF while in the US

My boyfriend and I started dating March 24, 2013. We lived in Korea until January 17, 2014. My boyfriend helped me move to LA for about 6 months and we returned together to Korea... me for 1.5 months... him continuously. We haven't seen each other for about 5 months now and won't be able to see each other for another 2 months. He'll be coming in February for 3 weeks and we want to see how things work out. We are thinking about marriage but due to family problems, are not sure if this is entirely possible. If he does come and we feel fit, we may get married and he will go back after his 3 week trip is over. I had lived in Korea for about 16 years before coming to LA and was wondering if it would make it applicable for me to file for the DCF even after he goes back? We don't want to be away from each other much longer.

You can only file DCF if you live in Korea.

I read on ***removed*** that they do allow people that are in the US and spouse abroad to apply for the DCF. Having been a resident of that country also helps... But, I was wondering how often this actually occurs.

As stated, no DCF unless the US citizen petitioner is resident abroad (usually a on a tourist visa doesn't count), and there is a USCIS field office within the US embassy in that country.

Part of the requirement to applying via DCF is to show that you've been and will be living in the foreign country for 6 months legally. I've heard of only a handful of cases of DCF without the USC living with the beneficiary in their home country, and I wouldn't be surprised if those were only due to some sort of emergency situation that required an expedite. I'd say your only shot at doing DCF is if you would move back to Korea.

How you going to file DCF in US. You literally have to walk the Petition to the embassy show your documents as a petitioners of continuous living as a legal resident. If it was that easy everyone on vacation would be filing DCF in whatever country.

Petitioners file DCF at embassy not the beneficiary so no it won't fly you filing in US. They are postmarked you know.
