Actually they only ask for last year's taxes, everything else is optional. Sending all 3 years is only an option if it'll help your case...in my case it wont, since I was a poor college student 3 years ago. Augh, I wish they would make up their mind!

Yeah, I noted that they said you "may" send the other stuff, but many many RFE's have been seen on here asking for all three so I'd send them if possible.

I've looked for more RFE's like this and I haven't found any :( my head is exploding here

Why? I know I've seen RFE's like yours before on this board so it's nothing unusual. Does your RFE tell you what they want you to send or does it just say send stuff to prove your above 125%? If so then you have a really good guide right in the I864 instructions on top of what we've said here, you'll be fine!

ok..here is the letter

Based on the documents submitted with form I-864 and the information provided on form I-864, the petitioner's or substitute sponsor's household income for the last tax year and/or current income does not meet 125 % of the poverty line for the household size calculated on form I-864. Submit proof that the petitioner's or sponsor's household income meets or exceeds 125 % of the federal poverty line for the household size provided on form I-864

If the sponsor's household income does not meet or exceed 125 % of the federal line, you must obtain one joint sponsor whose household income meets or exceeds 125 %. If required, the joint sponsor must submit the documents listed below and a completed and signed form I-864

- Federal income tax returns, W-2s, 1099s , and all schedules submitted to the IRS for the most recent tax year or certified Internal Revenue Service (IRS) copies.

- Statement in place of federal tax returns

- Extensions

- If using current income to meet, evidence of current employment including a letter from each employer, showing beginning date of employment, type of work performed, number of hours worked per week, and salary or wages paid.

Ok, well send them all the tax stuff and the employer letter and 6 mo of paystubs if you can and you should be fine. I've not heard of many (actually any, but I don't want to say it can't happen) RFE's after the person responded to an initial RFE with everything they want, so don't freak out :)

ok.. here is what is in the letter

Based on the documents submitted with form I-864 affidavit of suport and the information provided on form I-864, the petitioner's or substitute sponsor's income for the last tax year and /or current income does not meet

125 % of the poverty line for the household size calculated on form I-864. Submit proof that the petitioner's household income meets or exceeds 125 % of the federal poverty line for the household size provided on form I-864.

Send them what they asked for...no more, no less. You state that you are well above the minimum requirements. Resend the information. I was rfe's for two items. One was for not completing section seven of the affidavid of support ( the instructions clearly stated that it was not required) and the other was for a birth certificate that was included in the original submission.

Personally, I think it is a tactic to manipulate their numbers and timelines to take the heat off of them.
