Dao and I went for our AOS interview today, she was neither denied or approved.

We arrived about 35 minutes early and joined the back of the line, it took about 45 minutes to get into the building (raining) as they were using a side entrance because of construction in the front. Once in we proceeded to the correct office and dropped our appointment letter in the slot and had a seat as instructed.

About a half hour later an officer stepped out and called Dao's name. We followed him to his office, were sworn in, and started the interview. He asked the standard questions. He asked for a completed I693A, an updated employment letter, marriage certificate, and my divorce decree from my previous marriage. All this time he was marking her file with a red pen. He smiled took her I94 from her passport and stapled it into the file as proof that she entered the country legally. He looked at Dao and asked her about her finger prints. We explained that she had a cut in February and they were not able to capture her bio info and that we had been rescheduled for them in April. He asked if they had used the electronic fingerprint scanner, dao said yes. Well, as it turns out the fingerprints that were captured in April on the electronic scanner are "un verifiable". I know Dao's hands were very dry so that could have been the problem, but she said the scanner flashed green on every digit in April.

He handed her back her EAD card and said he will have to schedule her for new fingerprints before he can make a decision on the case. He mentioned that this was the third re-schedule and that if these fingerprints were not accepted this time we would have to have a police record search done as an alternative to finger printing. I'm expecting to see a new bio appointment in 4 weeks with the actual appointment about 8 weeks from today.

I'm very disappointed that someone did not catch the fact that they did not have valid fingerprints in the four months since the last bio appointment and automatically re-schedule her for new prints before her AOS appointment.

The thoughts going through my head at the moment are basically about the future. Her medical expires on Sept 15th (1 year) and I am worried that after they get good prints they will notice the medical and send an RFE for a new medical to be performed. Dao's EAD has an issue date of early February, so we may be looking at having to renew that at some point before AOS is finished. We were also planning on going back to Thailand in march, I guess I'll give it a couple of months before I decide if we need to file AP. She go's for her driving test on the 8th, but that might also be in jeopardy now because she is not a permanent resident (she has been driving on her thai license and an International Driving Permit for the past 8 months). Our state does mention that an EAD is acceptable for getting a driving license, but the visas listed under that provision do not mention K1.

Overall a very depressing day. We thought we were finally finished... then WHAM!

I'm sooo sorry to hear that your journey isnt as smooth as you hope.. It's a pain to wait and then have to wait again!! And i'm also sorry for the Driving Licence part... It's so easy to go around once you have a DL.. I'm so lucky that i got my DL when i was an Aupair and they gave me 6 years!! (before they change the policy to give it as valid as the visa) so when i went back to get my namd change they just change it and give it to me and valid for 4 years (it was 2 years after i got my DL)

So sorry again.. And HOPE that everything will go fast for you so you dont have to wait long (F)

It looks like we are moving right along, Jum received her biometrics appointment scheduled for Sept. 14th. Hope the process continues to move fast, maybe we will be one of the lucky couples!

Received a letter to appear for fingerprints in the mail yesterday, Dao's appointment is this morning! It appears the Interviewing officew was true to his word, One week after AOS interview and Dao is in for fingerprints.

A medical exam by a Civil Surgeon in the USA is required of K-visa applicants for adjustment only when the visa medical is more than 1 year old at the time adjustment is applied for.

Well.. Dao went for her drivers test here in CT on Saturday. They wanted the receipt for her I485 as proof of filing rather than the interview notice, so I drove to the house while she proceeded to get all the paperwork together for her test. About 10 minutes later while I was driving back with the requested form I received a call from Dao. Turns out she can not take the test because her SS Card is in her maiden name and her other documentation (I485 receipt / EAD) is in her married name. Even a certified copy of our marriage certificate was not acceptable.

Currently she is and has been driving on her International Driving Permit, but that expires on December 2nd. Her rescheduled appointment is on December 9th.

We did receive some good news earlier in the week, Dao received and accepted a job offer from a major airline! Congratulations Sweetheart!!!

Soooooo, once she processes her paperwork for her job (in about a week), we are going to hit the Social Security office, then start pestering the DMV for an earlier examination date. I guess I'll look back on this as proof that nothing worthwhile is ever easy.

It's been a year!!!

Today is my one year anniversary with Bram.. I'm soooo happy!! We are soo happy!!

This weekend i was in Asheville with my In-laws (Bram didnt go with me) so i got to plan what i got for him.. I got him a Belonghi Convection Oven with Rotisserie.. ohh... he loved it!

For me though.. it was a bigger surprise.. I was in Asheville wondering what Bram was getting me and today Bram drove to Asheville to pick me up and after we arrived home.. here it is... a GREENHOUSE!!!! I'm so SURPRISED!! Now I can grow all my Thai's spices and all my trees and flowers in my greenhouse!!! (i have a greenthumb and i LOVE my plants)

:D It's the best one year ever that's i'm with him.. And wish to be with him for all the years to come (F)

We immediatly went to the (SSA office next door) and showed all our documents to get a new card with her married name, but thet said her I94 had expired and they could not give a new card at this time. We were told to return after we recieve new proper documents after our AOS interview.

uuuggghhh... that could be a real problem for us as the interviewing officer at her AOS interview took her I-94. AOS is pending FBI name check, so we are not sure when we will get approval. I guess we will just go and try to get the new SS Card.

Yeah once the AOS is over with you can change the SS card. It only took a couple weeks to get our green card so we just did it then and there was no problem. Not sure the EAD card will work so you might as well wait just a little longer till you get the resident card. KnJ

Yep, we are moving right along. Looking forward to receiving the Welcome notice and approval. It will be a very happy day! The journey has only begun. It is strange to think that this time last year we were hanging around for the I-129F approval notice.
