.... we applied for a duplicate I-94 at a $160 fee. That kind of hurts since the POE officer made the mistake of not stapling the I-94 to Bennie's passport....or giving back to us at all.

I initially thought that the AOS might require my picture too, similar to the fiancee visa application, but I see that it didn't We just had Jum take her recent passport style photo to include with the papers, so all is well.

The I-765 and the I-131 are optional - 'up to you' as they say. But I see why she would want the I-131 from your subsequent post.

As anya-D asked - why do you need your passport-type picture?

They really sock it to you with all of the adjustment of status paperwork. I hope to complete it today, Jum did her part yesterday and I need to get my passport type of picture taken again today. So, here is what I am reading, $395 for the AOS application ($70 biometrics included), $180 for the Work Permit application, and $170 for the permission to travel outside of the country while waiting on the completion of the AOS process. That's $745 total if I am reading it correctly. Am I right?

You will want to take the originals of significant documents you submitted with your petition and her visa and adjustment applications - birth certificates, divorce certificates, marriage certificate, things like that.

For evidence of your relationship, well .... everyone is different. Take whatever you have that shows you two have established a shared life here in the USA.

Hey everyone. What are you supposed to take to the AOS interview when you already filed for the advance parole and work card. Most the stuff I already submitted. What should I use for supporting evidence of my relationship? Thanks for the advice

We received an RFE today. They say they need financial stuff from me, the sponsor. I gave them everything! Just like when we did the K1. Official IRS transcripts, letter from my employer, bank records etc.

The letter we got was a "generic" form letter. I don't know what they really want!

oh no.. i'm sorry to hear this... I dont know the answer to your question..sorry

But may be they lose it? they lose stuff all the time may be they did lose yours.. and hopefully you make a copy of your AOS package,,, just my guess of course ;)

This whole process is exciting. So many milestones to go through, I can't wait until we reach the finish line!

Yes, it is nice having the Homeland Security local office just 1.1 miles from where I work. Hope this means the process will be quick and easy.

Yes, Rich was not happy. The U.S.C.I.S. lady said it could take about 180 days. :blink: It's amazing how they can make a mistake and we are the ones who suffer. Regardless, the I-551 stamp in her passport gives us all the benefits of the Green Card for one year but still it's a bit hard to stomach. :(

Regardless, the I-551 stamp in her passport gives us all the benefits of the Green Card for one year but still it's a bit hard to stomach. :(

I'm new to this thread, I'm in BKK and Jason is going to file I-129 very soon once we're ready with all the documents and proof. Somehow I think I might have an 'overstay' problem since I lost my job when I had my H1B visa many years ago when I was in the US. We probably need to do a waiver if my visa is denied. Anyone has experience with this kind of waiver at the consulate in BKK? Any idea about BKK consulate? My experience with them couple years ago when I tried to apply tourist visa wasn't so good. Like many thai people would know about it. Any comment and suggestion will help, Thank you. (Khop khun ka!)

Dao and I went for our AOS interview today, she was neither denied or approved.

We arrived about 35 minutes early and joined the back of the line, it took about 45 minutes to get into the building (raining) as they were using a side entrance because of construction in the front. Once in we proceeded to the correct office and dropped our appointment letter in the slot and had a seat as instructed.

About a half hour later an officer stepped out and called Dao's name. We followed him to his office, were sworn in, and started the interview. He asked the standard questions. He asked for a completed I693A, an updated employment letter, marriage certificate, and my divorce decree from my previous marriage. All this time he was marking her file with a red pen. He smiled took her I94 from her passport and stapled it into the file as proof that she entered the country legally. He looked at Dao and asked her about her finger prints. We explained that she had a cut in February and they were not able to capture her bio info and that we had been rescheduled for them in April. He asked if they had used the electronic fingerprint scanner, dao said yes. Well, as it turns out the fingerprints that were captured in April on the electronic scanner are "un verifiable". I know Dao's hands were very dry so that could have been the problem, but she said the scanner flashed green on every digit in April.

He handed her back her EAD card and said he will have to schedule her for new fingerprints before he can make a decision on the case. He mentioned that this was the third re-schedule and that if these fingerprints were not accepted this time we would have to have a police record search done as an alternative to finger printing. I'm expecting to see a new bio appointment in 4 weeks with the actual appointment about 8 weeks from today.

I'm very disappointed that someone did not catch the fact that they did not have valid fingerprints in the four months since the last bio appointment and automatically re-schedule her for new prints before her AOS appointment.

The thoughts going through my head at the moment are basically about the future. Her medical expires on Sept 15th (1 year) and I am worried that after they get good prints they will notice the medical and send an RFE for a new medical to be performed. Dao's EAD has an issue date of early February, so we may be looking at having to renew that at some point before AOS is finished. We were also planning on going back to Thailand in march, I guess I'll give it a couple of months before I decide if we need to file AP. She go's for her driving test on the 8th, but that might also be in jeopardy now because she is not a permanent resident (she has been driving on her thai license and an International Driving Permit for the past 8 months). Our state does mention that an EAD is acceptable for getting a driving license, but the visas listed under that provision do not mention K1.

Overall a very depressing day. We thought we were finally finished... then WHAM!

Yes, the passport was stamped. Good for one year and I can only guess this is automatic now as we did not ask for anything. We only filed the I-485 and did not file for AP or EAD as they seem to be approving so quickly I did not want to waste the money. Oh well, the waiting game begins again.
