I would go, even if I had received written notice. USCIS has been known to screw this up, and if the local District or Sub office - which does not maintain the online status information - still thinks there is an interview it will deny the application for failure to appear. That problem can be corrected, but it will be hell.

Better to attend as scheduled and find out that the interview was indeed cancelled than to not attend and find out that the online status was wrong.

It's quiet in here lately

well I have a question for my friend. She recieved the Interview date a while back for Dec.5 and like a week ago she went to check her status online and it said that her interview has been cancle. They didnt send any notice to her yet and they didnt give her the new date...

The question is.. should she just go there anyway on Dec 5? to take the chance they might let her interview or that the online thing is wrong? it's coming up and she hasnt recieved any other notice..

Here's another question for another friend :blush:

My friend was an Aupair and she finished her program already and now is married to her USC husband (like a month after her visa expire) and now in the AOS process.

She hire an attorney and the attorney said becasue she was out of status for a while so she has to pay $700 fee for being out of status and the attorney also collect the application fee seperately.

I NEVER heard anything about "out of status" fee charged by USCIS? or is it really there but I dont know about? I thought being out of status is forgivien once married to USC?

My thought about this is the attorney just trying to get some money out of the newby

What y'all think? :help:

K-1 = 4 months

Anya, Ton was out of status for 6 months before we filed our AOS. Of coarse we were married before her visa expired. So far immigration hasn't given us any fines. Her interview is coming up on Jan. 16. So I will let all knw what happens ofter that.

Hello Everybody,

I remember all of you from the Sawasdee K1 thread, but I forgot all about the Sawasdee II AOS thread.

It's good to see everything is moving along well for most of you.

My wife, Mandy, has her AOS interview coming up very soon in January, and it looks as if she won't have EAD or AP approval prior to the interview. Can EAD and AP be granted by USCIS at the time of the interview, or must we wait for it all to happen via snail mail?

Mandy is really looking forward to visiting Thailand and seeing her family and friends again soon. She's been here with me nearly 6 months and, although she talks with her family and friends on the phone and online, she misses them alot. I totally understand how she feels. We want to visit Thailand in February or March 2007, and I hope we get AP approval by then. She also misses her "real" thai food, and I've tried almost every Thai restaurant in my area. "It's just not the same as Thailand", Mandy says. It's usually too sweet.

The only place we've been able to find "authentic" Thai food is either Thai Town or the Thai Temple in Hollywood. She prefers the food at the Thai Temple, but it's only available on the weekends.

I-765 and I-131 are processed at the NBC, not at the local office.

Unless there is something missing or requiring further explanation at the interview, Mandy should no longer need EAD and AP. In fact, if she has them by then, they will be taken away from her at the interview.

Yodrak,

Over $300.00 for EAD and AP and the AOS interview will take place prior to EAD and AP approval. Now that's a waste of money.

Mandy will have to wait for the actual GC prior to work or intl travel, right? How long from AOS interview to receipt of GC in the mail? We have a trip to Thailand scheduled for March '07.

Not necessarily. If Mandy's adjustment is approved at the interview she can ask that an I-551 stamp be put in her passport. This would cover her for both employment and travel until the I-551 card arrives.

If approval of adjustment cannot be granted at the interview, ask that they submit a request to the NBC to finish processing the AP and EAD applications.

From what I notice, how come some of you guys apply for the SSN atleast a couple weeks later after POE? I was thinking about getting up the next day and go apply for it after we're back to the US. Is there some sort of a waiting period where you have to go through or does it really matter?

Like Dan said, give it about two weeks before your fiancee applies for the SS card.

Your AOS was processed pretty quickly. Consider yourself lucky your case was transferred and you skipped the interview.

Our interview is tomorrow and I hope it's quick and painless.

No, you do not "have to wait at least two weeks". One can go sooner than that, and one might be lucky and find that their information has been entered into SAVE.

True, going the day after entry as EVOLUTION`proposes to do might be pushing things a bit and require extremely good luck. Then again, he just might have extremely good luck.
