Affidavit of Support advice needed

Hi all,

My fiance and I received our NOA2 approval about three weeks ago. I'm getting ready to send him the paperwork he needs for his interview. But I need some advice for the affidavit of support. Currently, I make 238% of the poverty line so I am fine with the income requirement, however, I have only had this job for 8 months so it is not reflected on my last tax return (I was in graduate school last year so my income was low, about 98% of the poverty life for a family of 2). I do not have a joint sponsor. Will we be okay? Is it a good idea to supply a letter explaining my student status in the last year? Any advice?

I think providing paystubs starting from a certain date would suffice. Others should be able to confirm or correct me on this.

-(then fiance) H-2B work visa application terminated due to qualification difficulties in Aug. 2010.

-(then fiance) B-2 tourist visa denied due to lack of strong ties to Germany in Sept. 2010.
-Third ESTA denied due to his suspiscious visa status on Oct. 15, 2012.
-B-2 tourist visa approved on Nov. 16, 2012!

 

(IR-1 Journey):

 

 

-Extended German residence permit obtained Aug. 23, 2014. (to qualify for DCF)

-Husband's new German passport picked up Aug. 28, 2014. (Old one expires 2015)

-I-130 packet sent to Frankfurt (DCF) Aug. 29, 2014!

-NOA1 issued Sept. 9, 2014 (received Sept.13)

-RFE regarding evidence of bona fide marriage received along with NOA1

-RFE reply packet sent to Frankfurt Sept. 30, 2014

-E-mail response (NOA2) received by USCIS Frankfurt on Oct. 23, 2014 (Petition APPROVED Oct. 20!!!) :dancing:

-Paper NOA2 received in the mail Oct. 29, 2014

-Case number assigned by IV unit Oct. 30, 2014 (Received by email Nov. 3)

-Paper "Packet 3" arrived in mail Nov. 4, 2014

-DS-260 and Document Delivery Registration submitted to Frankfurt Nov. 4, 2014

-Mailed in priority date request found on Packet 3 to IV Unit Nov. 5, 2014

-IV ("Packet 3") package sent to Frankfurt Nov. 17, 2014

-Medical completed by Frankfurt panel physician Nov. 17, 2014

-Received "Packet 4" via e-mail Nov. 20, 2014

-Interview booked for Dec. 3, 2014 (booked Nov. 21, 2014 after email authorization received)
-Visa approved, issued AND picked up by the courier all within 7 hours, Dec. 3, 2014

-Visa packet had to be returned to Frankfurt for correction on Immigrant Data Summary sheet (wrong birthplace listed) Dec. 5, 2014

Include an employment letter that lists your current annual salary and a few paystubs as proof of your current income.

The USCIS cares about CURRENT income. Let me give you another situation to make this point. You made 400% of the poverty guideline for the past 8 years. You petiton your foreign fiance(e). While the paper work is being processed, you suddenly loose you job and unemployment covers only 75% of the poverty guidelines. You submit your last three years worth of tax returns hoping the USCIS wil accept them as it shows more then enough income. You do not include any paystubs or a letter from your employer stating positon, hire date, salary, and that this is a permenant job. You get an RFE for paystubs or some other evidence showing what your income is at the time of filing. You will need to find a joint sponsor as your current income is not enough.

Just make copies of your last 3-6 months worth of pay stubs and get your employer to write a letter about your current job status with yearly salary and you will be okay. The I-134 is not a legal document and most Embassies/Consulates use it as you will need to complete the I-864 for adjustment of status (AOS) and meet those requirements after getting married. So you will need the same supporting documents again.

Thanks for all your advice! This helps a lot.

For the I-134 form, since my income is above 125% of the poverty line, can I just list that? Is it necessary for me to put any other information (like savings or life insurance policy info)?

Nope, just job info (paystubs, letter of employment). 3-6 months seems a bit excessive IMO. The last 2-3 paystubs should be fine (especially if you have the letter from your employer that is the same as on your paystub). Here is the VJ example that leaves the savings and other categories blank:

If they ask for it, such as how do you have in savings or checking then send in a bank statement showing what you write down is true.

They ask past years 1040 so since you do not have one or one you can use that will help you then send in a statement statements ng you could not provide it because you were in college but have such nce graduated, include something showing when you graduated.

I included everything requested for my fiancee she said they scimmed over it and said excellent! And Shoved it in the folder.

My point you can take a risk of an RFE / RFI or build a case for yourself that when they look at it they have nowhere to go or no further questions to ask. Thereby winning by default.
