There was a time when they didn't have the ceac website. You could call the embassy or the Department of State and be told you were in AP or that your case was being sent back to the USA. I think the ceac webite is a good thing because you have some way of knowing if they are working on your case.

This is so fustrating... I called Dos about a month ago twice and both times I was told that we are in AP and that they are verifying documents and as soon as they are finished they will contact us. So yesterday I called and was told that we are still in administrative processing, so I asked when was the last update and she said November 7, so I told her that I checked the ceac website and that it said last update was February 20. So, she then asked me when was the last time they contacted us and I said never, so she said that I should get in contact with the embassy, so I told her I have emailed them about 4 times and no reply, so she said keep trying..so in the end again she said that we are in AP but that the case is active...I wonder what she meant by active...

I would assume it means that your file is being looked at /worked on. Not just somewhere in the pile of files. These past few months I kept being told my case was under review, ever since that field investigation, when I call now, they say the same standard words , its in AP.

*sigh*

I just talked to the senator's aide and she told me they sent out the inquiry to the embassy last week, and that it could take 3 weeks maxiumum or less with a reply back. Does anyone have experience with congressional inquiry and how long they took to reply back?

The embassy responds fairly quickly to congressman...usually in a day or two. In my experience my state representative was more helpful and responsive than my state senator.

I started out using my congressman's office but during all the years of AP he retired. Then I used my Senator's office. I got excellent service from both of them.

pardon me, if i may ask....cuz i just faxed all my info to my congressman today....Did contacting your congressman help in getting your issued? Can you share your experience? Thanks :goofy:

Well, that is an interesting question. I don't really know if the congressman helped in getting my visa actually issued. What happened in my case is that my file (after 15 months of AP) was returned back to USCIS. I never received a NOIR. The liason was able to find out that my case was transferred to the San Francisco field office and then to the Sacramento field office (local to me). At my husband's interview the CO returned the entire contents of his file to him, including some very interesting documents that said "Do Not Release Under FOIA". These were checklists and forms related to determining if there are fraud indicators in the marriage. When my case was transferred to the Sacramento office, my liason contacted them and I was told to make an appointment to bring all the paperwork that had been returned in to the office. The next day a Homeland Security officer showed up unannounced...this was 9:30 on a Saturday morning. He asked to come inside to ask some questions. He also photgraphed my bedroom and closet (looking for evidence of another man living there). The officer sent my case back to the embassy (this was May) and it arrived back in Pakistan in July. My husband's visa was issued at the end of September that same year.

What was the type of help the state representative offered then the state senator?

The embassy is under the Department of State. DOS would have the same information as the embaassy.

I want to ask something from all of you folks.

In 2011 when my wife's income was not adequate, my brother in law was joint sponsor. He is alone and his income is way above poverty line.

When few days ago, US Embassy called me, the Pakistani lady told me few things. One of it was that your wife's income was less so you need to send an AOS by a joint sponsor.

I told her that my brother in law was already a joint sponsor. She didnt know that and said, wait let me check. After few minutes she found that but I could see that she doesnt have any clue of the facts. Then she said that you need to send tax returns of your brother in law for year 2012. But the information I found on department of state is quite confusing. Here it is

If the poverty guidelines change between the time the petitioner signed the I-864 and the issuance of an immigrant visa, must the petitioner/sponsor and joint sponsor, if required, submit a new I-864?

No, the I-864 remains valid indefinitely unless evidence of failure to meet the poverty guidelines in effect on the date of I-864 filing arises. The consular officer will determine whether the income claimed by the sponsor and documented with financial evidence meets the poverty guidelines in effect at the time the I-864 was filed. If the income claimed does not meet the poverty guidelines then the consular officer may request that the sponsor submit current year income information.

The reason I am asking this is because I dont want to ask my brother in law for arrange his tax returns for the year 2012 or any other year as once he gave AOS, its valid indefinitely. If something is already confirmed then why to ask for another evidence again and again? The lady who was a Pakistani locally employed staff might not be that much aware of laws and regulations. Also cant they check on their own about the figures of tax returns as they both are federal agencies. So please experts reply me about this.
