It doesn't mean that he won't get his visa just because they didn't keep his passport at the interview. They can ask for the passport when they are ready to issue the visa. I think the people who's passport they don't keep are the lucky ones. At least they can travel instead of the embassy holding on to it for months or years.

Thanks so much! :) This has had us worried the most about them returning my husbands passport, we are always thinking its because they want to deny his visa...hope not!

its good to be denied a visa rather waiting in AP..in deniel you can easily win the case from US courts..in 2 months filing writ of mandamus...u should know your US citizens rights...

Sometimes i think i made mistake and should have applied for fiancee visa instead and marry and do adjustment of status in america. Its easier to prove relationship here then abroad.

Yes...I agree with you here that K1 is better choice than IR1/CR1 Spouse category...

Few days before me and my wife were also discussing the same and we have 2 examples here on VJ who got visa under K1 category...One is Ahmad Jutt visa issued after 11 Months AP while other name is not in my mind who got visa after 4 months in AP...at least they got visas in short time than us...

At time of my interview also I noticed one boy looking from a village back ground near Multan city and was unable to speak Urdu well was on Fiance's visa...his interview took less than 5 minutes and CO retained his passport and said your interview is good and you will receive your passport within 2 working days...his fiance was his cousin as well from his father side...he was so happy and that's all...

I elaborated my experience and dunno if I am right or wrong but seems true that K1 is very flexible and convenient category than IR1/CR1(K3)

With K1 there is no trouble from the embassy about the size of the wedding or if the neighbors know about the marriage. Also with K1 I don't think different religions come into play as much. In the USA any religion can marry another.

If the visa is denied you don't need a Writ of Mandamus. You need to wait for the Notice of Intent To Revoke from USCIS which will tell you all the reasons the visa was denied then you will have 30 days to answer each emmbasy objection. The goal is to prove the embassy wrong so the case can be sent back to the embassy for another interview.

i would encourage you to sue uscis and dos because 8 years is enough to do processing. I read alot on internet that people filed lawsuit after 4 years of wait and they won their case.

no updates at all last was 4 feb i wish they just issued visa instead getting more updates im tired to seeing so many updates

in this days embassy seem to be very slow issuing more visas

They only make more work for themselves. I'm exhausted with this whole process already, dont know how people go in to it for years.
