Your case has been denied under section 221g of immigration and nationality act.

statute says, in part: "No visa or other documentation shall be issued to an alien if (1) it appears to the consular officer, from statements in the application, or in the papers submitted therewith, that such alien is ineligible to receive a visa or such other documentation under section 212, or any other provision of law, (2) the application fails to comply with the provisions of this Act, or the regulations issued thereunder, or (3) the consular officer knows or has reason to believe that such alien is ineligible to receive a visa or such other documentation under section 212, or any other provision of law

What does it mean guys? Anybody got clue?

this is what my wife got at the interview :(

that does not look like a normal AP to me since it says 'denied' anyone correct me if i am wrong that shouldn't it say 'under review' or something. has ur wife been to US before?

Welcome to AP family my friend. What they said to your wife how long it will take to finish their office work?

VO said after the interview that everything is ok from my side, nothing to worry about and kept my wife passport. And no additional documents required. Vo told my wife you will get your passport in 3 months. Vo also said that they have to get clearance from Washington DC. It has been 3 and half months in AP as of today.

I am not sure as well, that what kind of AP is this. But on 2nd paragraph of 221g. It also states that your case has been placed in administrative processing. If proved, we have your passport. We will place visa into it.

3rd paragraph states that when your visa is issued, you will have to pay $165 after you get your passport.

oh alright since i haven't seen any whole 221g letters anywhere in vj or internet i didn't knew what it said further on which u just expained

and if they have kept passport i think its a sign that this is just a normal AP and u will get passport back once visa is issued on it. insha'allah

That the exact same thing VO said to my wife that we have to do some office work and u will get your visa in 3 to 4 months... Its been 1 year she is in ap.

Main koi jhoota dilasa nhn donga but prepare your self for long time kyn k same wohi situation hai apki jo meri wife ki hai...

man i just had a mini heart attack reading your posts, I thought you read that off the ceac website, so this was the letter given to your wife, I think its just the dreaded AP.

That the exact same thing VO said to my wife that we have to do some office work and u will get your visa in 3 to 4 months... Its been 1 year she is in ap.

I know bro, VO just gives you standard time of AP. And as for as I know there is no priority date for spouse category. Correct me pls if I am wrong.

last update was on dec 8,

His 221g letter looked different, it just asked for additional documents. it didnt say what it said on your wifes letter. At the bottom they were three options, process for issurance and the other were refusal sentences, none of them were ticked marked.

i dont mind :)

There is priority dates for petitioners who have green cards and if the petitioner is a US citizen then there is no priority date, a visa is available.

Hi mueed,

It is standard statement under section 221g used for administrative processing. If they want any document they mark it on the same sheet.

VO said same to me but with a different time span of less than six months. But also mentioned there is no time frame. I have not seen even a single update after more than two months. I don't know how many cases here are because of mantis SAO so can't estimate time for my case. Same is for your wife.

I personally feel that its not us Pakistanis that cause long APs rather it might have been possible that many Americans were involved in sham marriages to get immigration. So authorities might be checking "BONAFIDE" nature of marriages or relationships and innocent are also punished along with culprits.

There is a belief that Pakistani men marry Western women for 2 reasons. Number one is to get out of Pakistan and the second reason is to find a job and send money back to Pakistan. I only know of 1 case where this happened. He walked out on his wife 2 months after getting here. He divorced her and married a Pakistani woman.

We have a saying here in the USA that one bad apple can spoil or make rotten the whole bunch. It only takes one guy like the one I talk about above to make all Pakistani men look bad.

what about couples who are both pakistani? why do they question the relationship of two people who come from the same background, religion and culture?

and if red flags are present such as age difference or previous marriage, what does the embassy do to get pass those types of red flags??

Sarach your question is great! I think even though they are both Pakistani and of the same religion and culture one lives in the United States and the other lives in Pakistan. The embassy can still say the marriage is for the purpose of getting a visa.

The embassy is not supposed to consider age difference but they do. The Pakistani must convence the interviewer that age or ability to have children does not matter. It's not right. In America we take pride in the fact that we are free to do as we choose as long as we are not breaking the law. I can marry a man 20 years younger than me in the United States with no problems but if I marry that same man and he is from another country the embassy gets upset. The embassy picks cases to make easy or hard. My friend Pat is Christian and married a Muslim Pakistani 20 years younger. He did 8 months of AP and got his visa. My husband and I fit the same type of case but it took me over 4 years to get him here.
