Permanent Residence/ Change of status

Timeline

Stressed: i'm the sponsor for my wife. after she arrived in the USA I became disabled,

we applied for permanent Residency, but the process was suspended with USCIS asking

for more income.

My relative has become a joint sponsor and my wife can work for my relative, between the 2

they meet the required income levels.

USCIS says they cant use the sponsored spouses income unless she was authorized to work

by USCIS/DHS example would be I-94 arrival record with "Employment Authorized" annotation

by the port of entry personnel.

They now say I have 40 days to find another Joint sponsor or get a denial.

Does any one know how get around this so that we can get approval.

it would be devastating to lose each other now that we are married.

Yes we applied for the EAD same time as permanent residency but they wont process

the EAD until permanent residency is approved.

Sounds weird because applying for EAD is an optional. You can file for your permanent residency alone, and oncegranted that's serves as your work permit.

EAD is just way of USCIS approving you to work for a minimum amount of time while they process your AOS.

Huh? that doesn't sound right. I already have my EAD/AP combo card and my Permanent Residency application is still pending. The only way around it is to get another sponsor.

They will specify the reason why it is denied and the action you will do on how to re-apply and based on your post it was denied because of not sufficient income to support your beneficiary which is your wife now. Find a friend, colleagues or relatives that has a enough income that could support you to file for her AOS or seek helpwith your congressman for a worst case scenario.'
