My wife's sons I-130 was denied because we wrongly submitted the birth certificate without translation( we got an RFE, she submitted the birth certificate, but again with out translation). We do not want to appeal, as the appeal is a waste of time and a no win situation . We want to re-apply for I-130. Is there a waiting period for us to reapply? We know why we were denied and want to start a new case but not sure if we need to wait.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes you can reapply immediately , now you learned the mistake next time always have the translated documents sent along.

No waiting period. You might want to reference the problem in a cover letter, as I'm thinking the initial round of background checks are already done for the first one, and that should speed things along a bit.
