Hi guys how are you all?

I want to ask if a family (F1 Category, single mother with two sons) goes to USA through immigration and then after getting green card one of the son's want to do engagement with a girl from Pakistan, so can he apply for his Fiance for US immigration even if he (son) is on green card?

I am sorry if its a very basic question :)

No. LPRs cannot petition fiancé/es, only US citizens can do that.

LPR's are only allowed to bring a spouse or unmarried children. Therefore, your son must marry her in order for him to petition for her. The current wait is about 2 to 3 years.

Very important, he must NOT get married until after he becomes an LPR (when he enters the US with the immigrant visa) otherwise he would lose his eligibility to immigrate.

Once he enters the US and is admitted as an LPR, he can travel back to Pakistan and get married then submit the petition.

So to conclude it is that:

Referring to this particular case only. The only way to apply on green card is to marry her.

And if he only wants to apply for her as a Fiance then He has to be US Citizen. LPRs cannot file Fiance visas only US Citizens Can.

Please correct me If i am wrong
