Hey Guys,

I've read that according to the law I can send my N400 3 months early which I'm going to do but was wondering...

I'm applying on the basis of being married to a US citizen and it says I need to provide evidence such as tax returns for the last 3 years. Obviously I have the last two years worth of tax returns and will do the third one in the new year. My anniversary is in Jan. Do you think I should wait, do my third tax return and send or go ahead and send what I have for the previous two years and hope they understand? Anyone done this type thing before?

Did you file at all three years ago? If you did, regardless of whether you filed single or married, you could submit that. However if all you have is two years of filed taxes, then that's all you got to submit. It's your choice if you want to wait to get the third one but not necessary. USCIS certainly won't deny you citizenship for not filing taxes on a year where you didn't need to file taxes. If you're worried about having only two years worth of taxes, you could always write a line about it on your cover letter.

Make sure you submit your N-400 package no earlier than 90 days early. There's a difference between 90 days early and 3 months early.

I filed for the first year I was in the US and then the second year, my year three mark will be Jan 2015. I guess I was worried because they say they want to see 3 tax returns but I wont be able to file my third until the new year and yet I'm allowed to file before that 3 year mark. I guess they have to expect that if I'm allowed to file early I can't provide evidence that I'm here at a future date. If you know what I mean?

Also just note that you can apply 90 days before you have been a percent resident for 3 years but you cannot apply until you have been married to your US citizen spouse for 3 years. So make sure you file after your third wedding anniversary even if it is before the third anniversary of your green card.

yes, I've been married over four years.

I read on another immigration website that they require the tax returns to ensure you are not a tax evader. So the "3 tax returns" thing is not as big a deal as showing that you have filed taxes. I guess I'm over thinking it, I mean, how can you be allowed to file early if you have to have 3 tax returns?

do you have apartment lease ? if so send that, and bring the full tax document when you have the interview.
