First at the consulate say that my fiance the usc had criminal record, the he sent his records clear, when the got it, then they said that me the beneficiary had criminal records. I sent my police certificate again on october 31,

Now on november 14 they sent me a letter asking by

my criminal history and inmigration hitorial written by myself, signed, sworn and notarized.

The problem is:how can i write my criminals records if i dont have criminal records and never i have been arrest?

How can i write my inmigration historial if i havent travel to any country?

Any dominican here that they are requering the same thing here?

Or if someone know what to do, i will apreciate.

I would write exactly what you just said. " I do not have a criminal record. I have never traveled outside of the DR. I have never been arrested." Sign it, and have it notarized by a lawyer and send that to them!!!!!

I still believe, as I have said to you many times before, someone has used your identity. It may have been stolen a long time ago and you were not aware of it until now.

That's why here in the U.S. is a good thing to check your credit often, and to sign up for credit monitoring, because Identity Theft is very prevalent in the United States.

I know that you probably can not sign up for anything like that over in the DR, but I still say I.D. Theft is the culprit. Let us know what the lawyer tells you.

At the interview i gave them my police certificate, and i have sent them more new police certificata, but they are stupid and continue asking for my arrests records but the thing is that i havent been arrests in my life.

I will contact Yadira Morel office tomorrow to see if i can do an aoppoinment with her, maybe she had worked with cases like that.

Ok, thats crazy, did they tell you why they were placing you on AP?

first they dont say nothing. After 5 months on ap they said that the usc had criminal records he sent his records clear then they changed their history and said that i had 2 arrest on their records i sent my police records again, but they insist that i need to send them my criminal records written by myself and all my immigration records and that i have one year to submit that.

But i cant write my criminal records because i dont have any and i havent traveled to other country.

They are playing with me first they say that was my fiance who had criminal records now that is me.

They dont know what they are doing, they stupid that is all.

From all the lawyers, Yadira Morel would be the last one I would contact...

I was considering contacting her for my visa process, so I talked to a friend that had an experience with her, she told me that after the first interview/consult, she was left with no answers and the only thing she could do was to fill all her documents and follow the case, something my friend could do by herself and she did, got her visa without Y. Morel's help.

Eventually I had the opportunity to talk to Yadira Morel at my own workplace, she was there with a client of ours, and I asked her something about my case which we already filed...I wanted to ask her about traveling to the US before the NOA2 and she didn't even let me finish the question, I only said we applied for the fiance visa and...that was it..she asked me if I had a tourist visa? I said yes, then she said you did it all wrong!! that's not the way to do it! you won't be able to travel, to do anything! (She actually recommended using the tourist visa) ..she said your boss and I are very good friends, I would had help you out, no cost!....I kept quiet..then I came here to VJ that night and read the pinned thread about traveling while on the K1 process and read that it is possible! I was considering visiting my fiance because we calculated the 5 months process and I wanted to travel in the meantime...and guess what? our NOA2 came 3 days later with approval! no RFE.

Now, your case is a bit complicated, personally I would't use Yadira Morel, but who knows...maybe she being a well known public figure she can put more pressure to the US Consulate in the DR.

Good luck

Thanks for your coments, really i dont need an immigration lawyer.

They want that i write my criminals records myself, signed, sworn and notarized.

As i dont have criminals records i will write a letter saying that never i havent been arrest and that never i havent been in other country. I will notarized that.

I was thinking use an immigration lawyer to try to find a best answer, but i dont have criminals records and i havent traveled to other country, so i dont need a lawyer realy, but this is the last thing i will do at the consulate the only thing they are doing is playing.

If they are asking for your criminal records, then I have to agree with the previous advice. Just sign the statement affirming that you don't have any criminal records because you have never been arrested and you have never traveled outside the DR.

By the way identity theft is starting to become an issue in DR. My cousin's husband had his cedula used by someone that was arrested and that person's jail sentence showed up on his police cert. Luckily, he was able to get it fixed before having to send the docs to the NVC.

It could also be that they are looking for someone with your same name. My cousin (same one) gets stopped every time she goes to DR at the airport when coming back because she has the same name as some wanted felon.

It has to be one of those things or something else because I don't think they would just make up that you have a criminal record or traveled outside the DR unless they had a reason to believe so.

This does not constitute legal advice.

I will write the letter and notarized with a lawyer.

About identity, i doant know wich is the problem.

A Coronel from police here checked my names and my cedula and nobody with my name has any issue at the police deparment.

the coronel told me that i am clean, that there isnt mistake with my name.

All that they are doing is playing, because frst they said that my fiance had criminal record then he sent his records clear and then they changed and say that i have criminals records.

That is simple they are stupid and charlatanes.
