Its not a matter of greater penalties, there appear to be no penalties for police shooting civilians, even when they're innocent by standers. But I've got to agree with the neighborhood and dress comment.

It used to be and there is some aspect of it in our civil system, that you'd have to pay for someone's worth in gold if you killed them. I'd like to see, but I know the police union would never let it happen, cops have to pay a huge fine for killing an unarmed person and potentially lose their pensions.

The results would be quick and I am sure the baton would make a comeback.

I have no idea why they decided to arrest and bring a person in who was making payments on unpaid parking tickets, but this type of thing seems a pretty big waste of tax payer money. She owed a $100 yet, I'm sure it cost more than that to drag her butt in, and seriously why even do so if she'd been paying, and why beat her azz? Well she probably lipped off, but that still doesn't give cops the right to beat the carp outa someone.

Some states suspend your license for any tickets unpaid. She coulda been that. What is known as a scofflaw. The cops may not have had updated info at hand. Many reasons.

They could have arrested her for suspended license, or simply being a Scofflaw.

But they needn't treat her like that. But how do we know how she was treating the cops?

I don't know if you guys know this. But at anytime that you get a summons, That's an arrestable offense. The summons is issued "in lieu" of arrest.

It's a historical thing.

At the moment ( ;)) there is not a great history of racial tension between the Chinese and blacks in America. However Tiff and I are working on this angle, now that I have promised her a Chanel bag!

Now this is kinda getting into my area of expertise.......

The NYC corporation counsel will likely indemnify this cop. And pay up. The cop will likely pay a portion of that settlement. maybe about 500 bucks.

Even if the cop owes the family of the vic, his check can only be garnished for 10%. And if he retires, a retirement check cannot be garnished (Except by IRS and Child support)

The settlement has got a lot to do with the dead guy's earning capability and various other factors surrounding his death.

The cop, will probably land on his feet in the long run.

this clown diblasio will likely pay out 10 million. The city has paid out almost 1 billion in lawsuit payments this year. A new record by the buffoon......

So is the cop in Detroit losing his license and paying a fine for shooting the little girl in the head?

But my complaint isn't about the shooting so much as the way too many police are treating the general public. It used to be you could nod you head and say hello, and you'd get the same back. Now you're more likely to get a scowl and an attitude thrown at you. Police departments are taking on this attitude that if you're not a cop, you're automatically the enemy. Sure if you're dressed nice you're not as likely to be hassled, but the person next to you not dressed as nice might be, and he might be more innocent than you. Police seem all about confrontation now, and not defusing situations. Not all of them mind you, certainly not all, but an increasingly large number of them. Heck I know a young woman, she just became a police officer, and I watched her pick up this confrontational attitude as a teenager when she joined the Police Explorer program. It was all you can't trust anyone, everybody has broke some law, gotta keep control, gotta keep the perps in line. And by perps, that was how they referred to all civilians.

The NYPD officer do carry a baton, an ASP, pepper spray, and some carry Tasers.

Doesn't matter. Garner died of cardiac arrest. Not asphyxiation. They could have tased him, and he woulda had a heart attack. He was 1 french fry away from that.

The cop, if he gets fired, he will lose his pension. But now in NY State, there's the municipal workers Pension protection bill. An officer with 20 years of service or more can only lose his pension if he gets convicted of a felony.

Now think about that one for a second. If a cop has over 20 years of service. And he gets charged with a felony.

The law says "Convicted of a felony" not, "Charged with a felony"

So if that cop retires, formally or informally. He's retired. His benefits begin within 30 days.

Now, between the time of arrest and Grand Jury, and Trial, what court in this country can convict a man of a felony within 30 days of a person is charged with it?

My friend the traffic court lawyer can buy a year before the case goes to trial......and that's if the grand jury indicts him......

so, what that means is, a cop with 20 years of service cannot lose his pension.

Now, I must shower and um....skip work. And eh....go get dim sum......
