Under the act, which also targets VOIP services, it is illegal "to cause any caller identification service to knowingly transmit misleading or inaccurate caller identification information with the intent to defraud, cause harm, or wrongfully obtain anything of value...."

See the intent?

It really depends on what you use it for. Without legal jargon.....if a law enforcement entity wants to use this system, they can. If it has something to do with certain fields, they can use it.

We don't use these numbers for marketing anything. And, the origins of these numbers are available to law enforcement agencies.

I guess it's legal. At least, that is what black box says. I briefed through the law a few years ago, we should be ok.

LE is pretty much exempt from this. Bill collectors and marketers, are highly limited on what they can do. Yes, it does have to do with what fields can be modified to. All bill collectors and marketers are required to use a number that can be called back during normal business hours. Further more, marketers are supposed to give the name of the company who's product they are marketing, even when they are marketing on behalf of some other company.

That was the last law that was put in place to further restrict fraudulent practices. Previous regulations remained in place even with the passage of that particular act. Laws upon laws type of thing. So you can read the last one, and think you're OK but run afoul of previous laws and regulations that we already in place and continue to be in place.

The media is most well known for spoofing their caller ID. (If you were Darren Wilson, would you answer a call from the Washington post?)

they may be running into trouble with the gaining information of value part. Or they should at least.

Earlier laws/regulations were mainly targeting marketing and bill collecting. Those regs are still in place.

My body hurts like hell, but we are piling up wood for 2016.

IMG_0078_zpsdfe44e09.jpg

That is a 129 year old spruce that was 112 feet tall. We're sledding them in by snow machine.

Gable on the left is three. He is just starting to grasp reading sentences. Donny on the right is four. We covered the Out of Africa human migration epochs and the resultant ethnic groups by global geography yesterday. It is integrated with the native American vs. European migrations to America, and mommy's Asian heritage. He is doing division in math now. School is every day here. Xmas break? lol. It is going to be a science symposium here.

I remember seeing films of Asian kids being driven academically, with the propaganda being how bad the kids' lives were having to study all the time. I wonder now. What we are doing is not only fun, but thrilling. Hard to believe you can do this and get away with it. Gable comes to us and says he wants to do school in the morning. The one on the right directs a lot of his own studies.

Usually it is a review of the previous day or a previous related lesson and then a new one. Three pages including diagrams for the four year old. It is high school level vocabulary so very soon his reading ability will be off the charts. Science - lol. Today he ordered a lesson on chipmunks. So it will be a lesson where they fit in on the Phylogenetic tree, their morphology, life cycle - it's work for me to prepare these lessons but well worth the effort.

can i have you number so I can forward them on rather than let them go to my voice mail?

And, you ever get a call from an insurance company? Try calling that number back.....lol

Insurance companies are pretty big on attempting to avoid laws and regulations. They'd rather hire lawyers.

The "good faith" clause in the United States code covers a lot of these oversights. The main thing is, if you're acting in good faith, it exempts you from a lot of other missteps.

For instance, you see someone choking, and you try to help him by reaching into his throat to remove a chunk of steak, but you end up wedging it in tighter, and the guy dies. Not only does your good faith remove you from criminality, but it also removes you from civil liability.

There is no good faith clause in marketing and bill collecting, they're a lot more restricted on what they can do legally. Although marketing companies have attempted to call their marketing phone calls surveys and get around the regulations.

But we're not marketing......or bill collecting......

Btw, even when your own bank or insurance company calls you, or even your doctor....that number may be spoofed.....our rather, from black box....

And lol, next time you check "I agree" to a disclaimer, try actually reading it. You've given your permission for them to spoof you lol
