You need to answer Yes to both questions 9 & 10.. That is positive.

It was a past K-1 and will also need to provide ALL copies of the Final Decree between you and the former spouse. Get this from the Courthouse in which you filed. Get a Certified Copy, signed and dated by the Clerk with a Seal from that Court. This should have already been required for the initial 129-F submittal in your application/petition. Did I miss something?

You in the past did file for another party so take my words as best you can whether that worked out or not.

So your first spouse came to the US on a K-1, you married, she got her green card, then you divorced. The answers are yes and yes. And unless you know for a fact that you have been released from your obligations under the I-864 that you signed when she got her green card then she is also included in your household size.

You submitted an I-864 for your ex-wife to get a green card, so #9 is YES.

You filed a visa petition on behalf of your ex-wife and present fiancee, so #10 is YES and you list both of them.

Not necessarily. Since you answered yes to #9, your ex is still considered in your household size. As long as your income is enough for your household size, there should not be any issues.

I have also answered YES to both 9 and 10 on my I-134. I also submitted proof that my I-864 was withdrawn from my previous ex. We had no issues at all at the embassy.
