Yes I believe an RFE resets the 90 days window to get your EAD, but it doesnt prevent you from actually getting it, it ust postpone the process which is sometimes annoying. Did you file in November? It would seem strange that you had an RFE for initial evidence now? If it is really the case you should start counting from the time the USCIS acknowledge reception of your evidence.

Filed it the same time as you, but when we got the RFE we were dumbfounded on how to reply because we had done everything right. Got additional evidence which takes forever in the middle east which now I realize was completely unnecessary. When we touched base with our lawyer he mentioned that he never sent what we originally gave him. Grr. That really sucks. I don't think my husband can take staying at home much longer. Thank you for the reply and kind words :)

On a side note, should he start applying for jobs after he gets his EAD or is it possible for him to start now? What's everyone else doing?

I just researched EAD timelines a little bit (for November filers) and I found several applicants who got an RFE that have already been approved, that gives me hope that the 90 day waiting period doesn't get restarted after all :dancing::dancing:

trust me it won't restart the 90 days. they say that but it seriously won't. I got an rfe for my ead at 75days of filing, and responded. It took them two days after they received my response to approve it. I believe they were ready to approve it and then they noticed that. so trust me once you send them the right evidence and they receive it and it goes into response review, you will get approve within a week or a little over a week. this was the same for at least two other people in the October thread as me and we got approve same way. so believe me. your ead is at the final stage and they will pick up from there. my rfe was for initial evidence too. stating that I changed my name. Good luck.

trust me it won't restart the 90 days. they say that but it seriously won't. I got an rfe for my ead at 75days of filing, and responded. It took them two days after they received my response to approve it. I believe they were ready to approve it and then they noticed that. so trust me once you send them the right evidence and they receive it and it goes into response review, you will get approve within a week or a little over a week. this was the same for at least two other people in the October thread as me and we got approve same way. so believe me. your ead is at the final stage and they will pick up from there. my rfe was for initial evidence too. stating that I changed my name. Good luck.

I agree, the reset of the 90 days is very theoretical and it mostly sets people back a week or two in most cases. As for employment, as long as you have a clear idea of when you will legally be allowed to work, going for interviews is fine IMHO

Applying for jobs and having interviews is totally ok as long as you don't work until you have your EAD.

There is no special visa for job interviews for foreigners, so they would get a tourist/business B1/B2 visa to go to the USA to have an interview with an American company before actually applying for H1-B work visa. (my experience before I moved here).

Do they let you know when the card is actually produced and mailed? Or you just had to wait and check the mailbox 3 times a day :) (This is what I am doing - lol)

Mine yes . Yesterday, Jan.29, my case changed from "the card was ordered to be produced to "my card was mailed to me".Can't wait to have it on hand. I wanna work asap :)

No updates for me either... I have been planning to visit my parents/friends in the end of February and now I'm not so sure it's possible.

If no updates for us by the end of the next week then I guess we should start contacting USCIS.

it depends on when you mailed your AOS and when you got the NOA. You can count 75 days since the day, indicated on your NOA, and if it has been over 75 days - you can call them. I got mine approved on the day 72.

it might also depend on your local office and how busy they are.

A good thing is that EAD an AP get approved on the same day. So you can travel with no problems. I am pretty sure you will get your EAD/AP soon!
