is it possible to do AOS from F1 to permanent resident if we marry?

so long as we prove it's not fraud, is it possible? I would assume it's quicker than K1 or K3, correct?

AOS, AP:

02-09-07 - Legally Married

02-20-07 - AOS and AP mailed to Chicago

02-27-07 - NOA1

03-15-07 - Biometrics done

03-19-07 - AP Approved (AP was expedited. Emergency Advance Parole done at the immigration office)

03-26-07 - AOS Interview on 5/17

Advance Parole Approved in under 30 days.

Just under 90 days from AOS filing to AOS interview. Not bad! :)

As an F1 your main purpose was to come and study, depending how long you have been in school that will give more credibility, IT happens so in the interaction with people, classmate, you might find someone that you fall in love with, there's nothing wrong with getting married in the states, The question comes down to Intent, when you moved to the country did you intend to immigrate in order to get married and stay here OR to come and study, So if you have been studying here and meet someone that helps your situation a lot comes interview time as you can show you were here for your studies then met your lifepartner, once marry you can file for OAS, the only thing your status will change once you file for AOS. The good thing, once marry then you also may not have to pay for out of state/Foreigner tuition, you may qualify for resident rate. Good luck

Well there was no intent. She has been up here numerous times. There is so much proof we can show to prove she was up here to study it's not even funny. She has literally come to the states over 20 times over the past 20 years including her entire immediately family. In addition she did the entire visa application process for her F1 in a matter of 3 weeks - from making the appt to visa in hand using the emergency process which is unheard of in brazil nowadays.

There was no intent on getting married and it can be proved.

All I want somebody to say is that it is indeed faster (and possible) to just to AOS than start from scratch from a K1 or K3. :)

It sounds like it is. I'll definitely get a lawyer but I just wanted to get the initial question out of the way.

Can somebody confirm?? :help:

Edit: and from my previous posts it's not in regards to the same person. This is honest proof but looks like a bad coincidence.

No one here can guarantee any timelines for you. We don't know your history, or hers, or where the potential delays may occur. Consult legal counsel and see what they say.

It doesn't matter what her intentions were when she originally got the visa.

It doesn't matter how many times she's used the visa for entry in the past.

It doesn't matter how long she's gone to school.

It matters what her intentions were regarding immigrating at the time she used the visa for entry to the U.S.

If she was already in the U.S. when the notion to marry and stay came about, there is no fraud.

If she is now outside the U.S. then using the F1 visa to enter with the intent of staying based on a subsequent marriage is fraud.

If you are already engaged, like it sounds you are from a previous post, then there is DEFINITE intent if you are planning on her coming to the US on an F1 visa, getting married and then skipping straight to AOS. It is illegal (and wrong) to come into the USA with the intention on getting married and staying without the proper visa (the F1 is not the right visa for this). You won't find much sympathy at all from VJ members if you are trying to skip out on the legal steps to get processed faster. We paid lots of money and have invested a lot of time to do things the legal way and you would be well advised to follow the legal route as well.

sounds good. So I'll take those answers as a "yes" you can do AOS from a visa.

She IS in the country and we had no idea this would happen. She came up here, started going to school. Then we dated, then got engaged. In that order. With proof.

Aaagh it gets frustrating when people try to play inspector gadget instead of take my word for it that this was a legit fact of life. As one of the replyers said "it happens" and that's exactly what happened. If she was not up here for school in the first place, we never would have became friends and gotten engaged. It's that simple. Believe it or not, there are people in the world who fall in love with students here on F1 visas and that is what happened to me. So because of this, it sounds like we have an option to do AOS instead of the whole K1 or K3 process from the start.

But I got the main answer I wanted that it is possible. I will handle the "intent" issues and what not up to a professional with all our information being honest under whatever contract or oath or whatever they want to give.
