AOS - I-864/I-864EZ and support

Hello Vjers,

For the AOS package, Do you fill out the forms I-864 or I-864EZ -

I'm the only one sponsoring my spouse.

Also based on these two guides -

it mentions to

Last 3 years IRS Tax Transcripts (otherwise, last 3 years 1040 and W-2/1099)

  • Original Employment Letter
  • Pay stubs (include a few recent ones and a selection from throughout the previous 3 years)

In the EZ form though only mentions to attach Transcripts -

Should I still put original Pay stubs as well?

If you use the EZ version (which I recommend if you qualify) then attach 1 or 3 years tax return transcripts plus proof of current income including pay stubs and/or an employer letter.

Keep in mind you qualify for the EZ if you are the only sponsor, you are only sponsoring one person on the petition, and one or more w2s shows your entire income above the poverty guidelines.

so if I have the employee letter, there's no need for pay stubs ?

Also, based on a previous link, the poverty guidelines for 1 person is about 20K? and we need to meet above that 125% right NLR? Do we have to submit our W2s ? to prove that we're qualified to do the EZ? or the transcripts are good enough?

Your tax return transcripts provide all the information the NVC needs to send the AOS to interview for approval from the CO. :)

thanks again for your advice NLR. I'll definitely submit some of my original paystubs. (just wanted to thank you again for your ezspouse guide, its gotten me preparing for everything as much as I can, until I get the case number from NVC. I'm going to call them next week (I just got my NOA2 the other day, and got another NOA saying that they sent it over to NVC on November 4th).
