my situation is complicated because I never thought that will happen.

I had a long relations ship before in Egypt with American girl that started online in 2012 then we met in 2013 we had a complicated love story until we decided to end it I think before my birthday 2013

I came to the states in 2014 june to study in California (she is in Nevada) we didn't communicate until recently and I visited her.

We decided to get married, we want to do that ... plain and simple!

well... yes it's a real love, her son calls me dad, I never had the same feelings with another person before, I am afraid that uncle Sam will separate us.

I will have the break on Dec. 11th I wil go to her and get married but I need to skip at least the next semester (the school is in California we will get married in Nevada) so the next semester starts at Jan 20 I am afraid the school will tell uncle Sam that I am a bad student and take the F1 status from me. I am in a complete mess. I want her but I don't want to break the Law I want to hire a lawyer because I don't want to break the law too. I just need advise on what to do.

*ps: when I came to America I never had that idea on my mind,... ever! I don't know how to prove that though.

No problem. All transgressions (except pedophilia) are forgiven after you file AOS.

But why are you dropping out of school for a semester?

Don't tell us that it is because you (and she) don't have enough money; and that you (and she) don't have money to file for AOS.

Then you will have bigger problems.

December 4, 2018, ordered your new card for Receipt # EAC17297003XX, and will mail to the address you gave.

491 days from NOA issued by VSC until Petition approved.

December 7, 2018 USCIS sent notice:  Card mailed.

December 12, 2018 Ten year Green Card received from Lees Summit, MO

499 days from NOA issued by VSC until Green Card received.

December 6, 2018 submitted N-400 application on-line.  Estimated Completion Time: 8 months or August 2019.

December 8, 2018 received notice on USCIS that Biometrics scheduled . . . but the actual date was not yet shown.

December 11, 2018 saw in 'Documents' section of USCIS that Bio scheduled for 24 December 2018.

December 21, 2018 saw on USCIS website that they will be closed 24 December 2018 as extra holiday.

January 9, 2019 went for re-scheduled BIO appointment.  33 days after N-400 submitted on-line.

February 19, 2019 received letter in US mail that Citizenship interview scheduled for 26 March 2019. 74 days after submission on-line.

March 26, 2019 Citizenship interview scheduled for.  109 days after N-400 submitted on-line.

March 26, 2019 Passed Citizenship interview.

April 12, 2019  Received notice that Oath Ceremony had been scheduled for 24 April 2019.  17 days after interview.

April 24, 2019  Oath Ceremony completed.  29 days after interview.     139 days after N-400 submitted on-line.

April 25, 2019  USA Passport Application submitted.

May 3, 2019     USA Passport received.    149 days after N-400 submitted on-line.

I do have money but going to school 600 miles from where we will live together will be a bit difficult

I also have to leave my current job at the school but I can afford a lawyer.

The other irritating thing is her current job isn't above poverty line

we need to prove that I am not going to be a public charge... well I know I will not be but uncle sam will need evidence I guess

I think my options after that is to transfer credit to a university in Nevada but we have to file the paper work first because I don't want to be illegal.

You will be unsuccessful in filing the paperwork because, as you say, she won't meet income guidelines.

Forget the whole lawyer thing, it's not really needed unless you have issues with your immigration history or some criminal stuff as well. Save the money for your paperwork fees. Your best bet is to initiate a transfer process to a university in Nevada so you don't fall out of status if you're so concerned being on valid F1. You can do this while simultaneously marrying and submitting your adjustment of status. As for her low income you can solve that by having a joint sponsor on the affidavit form who is a permanent resident or u.s. citizen. It's good to keep your F1 status still though as you go through this process just in case something happens during your adjustment and it gets terminated through divorce or cold feet etc then you have some status to fall back on to.

8/25/2014: Received biometrics letter in mail scheduled for 9/8/2014


9/8/2014: Went in for biometrics.


9/24/2014: I-765 EAD Card/Document production, text/emails. 36 Days! I-485 still in acceptance and I-130 in initial review.


10/01/2014: EAD mailed, text/emails received.


10/03/2014: Received EAD card.


10/14/2014: I-485 finally moved to Testing and Interview. Coincidentally called USCIS today about it being stuck in acceptance hours earlier.
