Anyone waiting for AOS since 2005...

Timeline

Hi everyone,

I tried to search timelines, etc but couldn't find what i needed to. We've been waiting since Jan. 2005 for our AOS and other things. Has anyone else been waiting since 2005 for their AOS and their interview? We were called for a Feb. 1 interview which was then cancelled.

Besides the name check possibility any other theories as to what is going on? The 1-800 folks have taken 2 inquiry calls and no one has bothered to respond. We also wrote to USCIS (snail mail) and AGAIN nothing.

I tried the Senator route and that also didn't help. I'm running out of options. I scheduled an infopass for this week but I feel that again we will be given no information.

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

It may be time to set a lawyer on them and sue. Such lawsuits seek what is called a "writ of mandamus” — a court order requiring a government agency or official to perform a duty, in this case, to process an application.

Yes, my lawyer said the same..sorry i meant January 2006. (sorry!)

I really fear that the writ will be the way to go, esp. in light of the EAD issues as well! However, my lawyer says that though we may spent $2K undertaking that this doesnt guarantee anything which is really upsetting. They can still take their sweet time making a decision.

I have seen people wait up to 2 years, your case is not unusual, it can take time for the FBI to do name checks.

Go, completely prepared to the place at the correct day and time for the original interview date! This has been happening to several people on the forum: they went to a 'cancelled' appointment and were treated as if it had not been cancelled.

So, be there on time!

And if you got an interview that quickly, your are very lucky: ours took over a year!

we had our interview in jan 2006 and still waiting.

contacted congressmans office and they say all u can do is wait. there are alot more who have been waiting longer then ours.

had 3 info pass apts... they say all u can do is wait.

had info line put in a service request...we are in background check so our petition has been on hold....dont contact us again for 6 months.

final answer.....WAIT

So, be there on time!

And if you got an interview that quickly, your are very lucky: ours took over a year!

If your CIS office is nearby you may want to show up for that canceled interview, sometimes the system says canceled but your local office fails to get notice and then puts you down as a no-show when you fail to show up.

Yes, good references, and do you also have links to some of the threads where the people believed that the interview was cancelled, failed to attend, and then received denial notices for failure to show for the interview?

People who receive those cancellation notices should be very wary.

arghh we're in for a wait. Took us a bit over a year for the interview and now they've cancelled. I expect to wait many more months. We've had petitions sit with USCIS so we're expecting the worst.

We're gng for the cancelled interview just to make sure we aren't later accused of abandonment. thanks and i hope for those who have been waiting that you are approved soon.

To be honest, I expected a delay but not for the EAD. I wish they'd let my husband work.. :(

I'm sorry to hear all of this, but yes, go to the cancelled interview. Some people have gone and got accepted!

But your wife had not filed her I485 and I765 over a year ago before receiving her card either.

We also filed in January of 2005 but I noticed in another post that you actually meant January 2006. We didn't get our interview until September of 2006 so you still have 8 months to go to match our wait time.

We also had a cancellation, also did the Infopass and Congress Critter thing. All without any success. All they ever said was just to wait, so we waited We saw many others who filed before us get their interviews and green cards in a timely fashion but we just kept waiting. No reason was ever given why it took so long and I'm sure none will ever be.
